Der Milchindustrie-Verband ist der Spitzenverband der deutschen Milchindustrie: Rund 80 leistungsstarke private, genossenschaftliche und multinationale Unternehmen. Rund 95 Prozent der deutschen Milchanlieferung oder 30 Millionen Tonnen Milch und 90 Prozent des Exportvolumens werden von MIV-Mitgliedern erbracht. Mit rund 27 Milliarden Euro Jahresumsatz ist die Milchindustrie mit der größte Bereich der deutschen Ernährungsbranche. Der Milchindustrie-Verband ist Interessenvertreter und Dienstleister auf regionaler, nationaler, europäischer und internationaler Ebene. Der Milchindustrie-Verband ist die zentrale Interessen- und Informationsplattform zum Themenkomplex Milchwirtschaft. Wir vertreten die Interessen unserer Mitglieder gegenüber Entscheidungsträgern aus Politik, Verwaltung, Wirtschaft, Handel, Wissenschaft und Forschung sowie Medien und Öffentlichkeit auf nationaler und internationaler Ebene.

Response to Review of the requirements for packaging and feasibility of measures to prevent packaging waste

In Deutschland arbeiten die dualen Systeme seit Jahrzehnten mit einem Müllsammelsystem inklusive der Sortierung und Verwertung von Verpackungsabfällen aus den privaten Haushalten. Dieses System wird kontinuierlich erweitert und verbessert. Die deutsche Milchindustrie ist der größte Zahler von entsprechenden Lizenzentgelten an die genannten dualen Systeme und übernimmt damit bereits seit langem die Verantwortung für eine sachgerechte Entsorgung der gebrauchten und entleerten Verpackungen der privaten Haushalte. Insofern erlauben wir uns eine ausführliche Stellungnahme zum Verordnungsentwurf.

Response to Revision of EU marketing standards for agricultural products

The Association of the German Dairy Industry, Milchindustrie-Verband e.V. (MIV), welcomes the opportunity to provide comments on the European Commission’s In-ception Impact Assessment (IIA) on a revision of EU marketing standards (Ares (2021)427166 of 19.01.2021). A scientific definition of “sustainable products” is crucial before new legislation is proposed. Any possible sustainability objectives should not be tackled through verti-cal marketing standards rooted in the Common Agricultural Policy (CAP) but be ad-dressed through a horizontal regulation applicable to all foods. This will allow con-sumers to choose according to their specific needs and wishes. Only a horizontal and holistic approach will be able to increase the level and choice for sustainable food. Response to Revision of the EU geographical indications(GI) systems in agricultural products and foodstuffs, wines and spirit drinks

Milchindustrie-Verband (MIV), the association representing the German dairy industry, would like to submit two comments regarding the revision of Regulation (EU) No. 1151/2012: 1. Application, examination and registration process As noted earlier in the context of the amendment to Regulation (EU) No. 1151/2012, we are of the opinion that the EU Commission should not only check applications for protection according to art. 50 Regulation (EU) No. 1151/2012 against obvious errors, but rather comprehensively, whether the requirements laid down in the regulation are actually being complied with. After some deadlines were already shortened in the last revision, this is still missing for the review period of the EU Commission after the consultation procedure has been concluded (art. 51). We therefore propose the addition that the EU Commission has to bring about a decision, through the committee procedure according to art. 57, within at the latest 6 months after the conclusion of a consultation procedure in accordance with art. 51 par. 3 subpar. 2. This would avoid situations such as in the "Havarti" PGI protection procedure, where it took almost 5 years between the completion of the consultation and the registration decision. 2. Generic names The issue of generic names is always controversial, especially when an application is made to protect compound names and the question arises as to whether part of the compound name is a generic name. The current protection procedure “Mozzarella di Gioia del Colle” is again an example for this. In art. 41 par. 3 of Regulation (EU) No. 1151/2012 it is already stated that the EU Commission has the power to issue delegated acts with further provisions in order to determine the generic status of terms. The Commission should finally proceed with this task in order to avoid numerous opposition procedures regarding compound names.

Response to Farm to Fork Strategy

Milchindustrie-Verband e.V. (MIV), welcomes the Green Deal initiative of the European Commission of 11 December 2019. As regards the part on the “Farm to Fork” strategy, we agree with a holistic approach that shall cover the whole food chain and make it economically, socially and environmentally more sustainable. The Commission wants to stimulate sustainable food production and create new business models for food producers to thrive in a sustainable food system. It wants to help consumers choose healthy and sustainable diets by providing better food information such as on where the food comes from and its nutritional value. We are especially concerned by the two last points, origin labelling and information on nutritional value. A mandatory approach on origin labelling for milk and dairy products would economically not be sustainable and destroy current business models that create added value in the food chain. It would lead to a renationalisation of the internal market which the ECJ has ruled as illegal in several judgements. More detailed arguments can be found in the attached document. With regard to better consumer information on the nutritional value of the food, we believe that any new labelling system should be science based, be in line with national dietary recommendations and take into consideration the nutrient richness of dairy. So far we have not seen any labelling system that would fulfill these conditions for dairy products.

Response to Commission Regulation setting maximum residue levels for chlorate in or on certain products

The German Dairy Association (Milchindustrie-Verband e.V., MIV) welcomes the opportunity to provide comments to this draft regulation. MIV strongly ask the Commission to apply the MRL of 0.1 mg/kg for “other dairy products” on products “as consumed”, because concentrated/powdered products have to be diluted before consumption. This reference (“as consumed”) is in line with the delegated Regulation (EC) No 2016/127 on infant food (Article 4). We support the reversion to the previous proposed MRL of 0.04 mg/kg for raw milk. We also ask for the addition of an appropriate timeline for implementation. The dairy industry requests that the European Commission gives an appropriate consideration to the ongoing Drinking Water Directive (DWD) discussions during the development of this draft legislation for the setting of MRLs for chlorate residues. Member States chlorination is applied to ensure safe drinking water in compliance with the EU Drinking Water Directive, which is currently under review. We call for a consistent EU legislation concerning the chlorate regulation for water and foods. In addition, we believe that Regulation (EC) 396/2005 is not the appropriate legal framework for the management of multiple source substances and especially chlorate, for which several different entry points may occur across the supply chain up to the final product intended for the consumer. The possible presence of chlorate residues in food has been found to come from multiple sources, like drinking water.
