Response to Reporting scheme for data centres in Europe

As a research institute that has been working on the energy efficiency of data centres for more than a decade and helped to develop the minimum requirements for the German Blue Angel ecolabel for data centres, we welcome the adoption of Directive (EU) 2023/1791 on energy efficiency and the information requirements for data centres contained therein. We hope that this will create genuine competition for the most energy-efficient data centres and enable greater environmental transparency in the IT industry. In particular, we welcome the establishment of a European energy efficiency register for data centres. We would like to take the opportunity to provide qualified feedback on the draft delegated act on the establishment of a common Union rating scheme for data centres and send the EU Commission a few relevant comments on the draft in this policy brief. Response to High and low Indirect Land-Use Change (ILUC) - risks biofuels, bioliquids and biomass fuels

In principle, the approach of the draft Delegated Regulation is suitable to address the requirements asked for in the delegated act of RED II, which is to set out the criteria for certification of low indirect land-use (ILUC) change-risk biofuels, bioliquids and biomass fuels and for determining the high indirect land-use change-risk feedstock for which a significant expansion of the production area into land with high-carbon stock is observed. However, we strongly recommend: - to set the threshold for identifying high ILUC risk feedstock to 4% instead of 10%; - to delete the term “abandoned land”; - to improve the definitions of additionality measures and additional feedstocks; - to improve the criteria for additional feedstocks gained from improvements in agricultural practices, or otherwise to exclude this option of an additionality measure; - to include safeguards for preventing abuse with regard to small holders.
