Response to Revision of the NIS Directive

NIS roadmap recommendations Palo Alto Networks is the global cybersecurity leader with a strong and continuously growing presence throughout Europe and around the world across the private, public, and Critical National Infrastructure sectors. We support the European Commission’s intention to take actions that would build upon the NIS Directive to help it more effectively meet its stated goal: to boost the overall level of cybersecurity in the EU. We agree with the objectives laid out in Section B of this roadmap/impact assessment: To achieve a “Europe fit for the digital age”, the EU must ensure a state-of-the-art response reflecting the new needs for increased cybersecurity. Such a response should aim at increasing preparedness at the national and EU levels, by building up robust capabilities to prevent, detect, respond to and mitigate cyberthreats and to be prepared to act in crisis. Furthermore, a response should enhance the cyber resilience of all key economic sectors. In terms of possible policy options presented in Section B to achieve these objectives, we would suggest either #2 (non-legislative means such as guidelines) or #3 (regulatory intervention that introduces targeted changes to the current NIS Directive), or a combination of both. Regardless of the instrument chosen, we recommend the revision of the Directive include the following: Update and refine the security requirements for OES and DSPs. The security requirements should be updated to point to more appropriate examples of “state-of-the-art” technologies like automation and prevention technologies based on machine-learning. These should be accompanied by internationally accepted risk management standards. Enhance compliance assistance and enforcement. We encourage the European Commission to develop more impactful means whereby ENISA and other relevant European and national competent authorities clearly inform businesses what steps they can take to manage their cybersecurity risks and leverage technical guidance to comply with the Directive. Promote supply chain security. The European Commission should explore whether to include requirements for essential services organisations to adopt supply chain best practices. This could include transparency and how ICT vendors demonstrate adherence to best practices. Take steps to better ensure harmonisation implementation of the Directive across the EU. Take a thoughtful approach to revisiting the Directive’s scope of essential services covered. Should the European Commission decide to expand the scope, it should do so in a thoughtful way that drives security-based outcomes and avoids duplication with other existing security regulations. Revisit the role of the NIS Cooperation Group, such as by providing it with enhanced powers/or an enhanced mandate to ensure effective implementation of its NIS-related guidelines on technical measures. We have detailed these six areas in a paper (attached as a separate file), “Palo Alto Networks recommendations for the revision of the Directive on security of network and information systems (NIS Directive), 2 June 2020.” Please note we wrote these recommendations in advance of the European Commission’s official “Consultation on the revision of the NIS Directive” launched in July 2020 through early October (we plan to augment our initial suggestions in our response to that consultation) but we hope this June 2020 paper provides useful ideas at this stage. Palo Alto Networks looks forward to participating in the official public consultation and contributing our expertise via any interviews, regional workshops, and focus groups that the European Commission will hold to help policymakers to gain a deeper understanding of current cybersecurity challenges, the evolving threat landscape and to discuss policy options for a potential revision of the NIS Directive.
