IFPI Urges EU to Protect Music From Online Piracy

Message — The IFPI requests that anti-piracy recommendations cover "all types of live and time sensitive copyright protected content," including "unauthorised pre-release content." They call for "expedited, dynamic, catalogue wide" injunctions and "notice and stay down" requirements for all host providers.123
Why — Expanding the scope helps labels prevent commercial harm caused by unauthorized music leaks.4
Impact — Online intermediaries would face stricter transparency requirements and higher costs to ensure compliance.5

Response to Intellectual Property Action Plan

IFPI represents the interests of the recording industry worldwide. Our membership across IFPI and its network comprises some 8,000 major and independent companies in over 70 countries including in EU Member States (MS). In its Roadmap for the IP Action Plan the Commission recognizes that IP infringements remain a problem. We fully agree. The unauthorised use of music online remains an industrial-scale problem for the recording industry. Millions of takedown notices are being sent every year, but even if services comply, the unauthorized content usually reappears within seconds. Direct actions against unauthorized services are often impossible because they operate in complete anonymity, in many cases supported by certain digital services/intermediaries. Even if litigation is an option (either directly against a service or against an intermediary), right holders need to bring action in each individual MS. The absence of any cross-border effect is expensive and highly in effective. Illegal services continue to rely on different digital services/intermediaries including ISPs, hosting providers, domain registrars/registries, search engines, payment providers, app stores, content delivery networks etc. These services could and should do much more to prevent that their services are being used by illegal services. IFPI welcomes the recent announcement Digital Service Act (DSA) framework which, inter alia, recognizes that digital services including intermediaries should have more responsibilities and obligations to assist right holders in tackling illegal content online. In addition, we encourage the Commission to also address the shortcomings in relation to IPRED. While the guidelines published in 2017 included a few positive statements (e.g. regarding dynamic and catalogue-wide injunctions ), they are ultimately insufficient to solve the problems because they are non-binding on MS. Further, the guidelines did not address or remedy the fact that many MS have not correctly implemented IPRED. The Commission should call on MS to ensure that IPRED, 16 years after its adoption, is fully and correctly implemented at national level. The following aspects should be addressed in order to create a well-functioning internal market for IP protection: (see also attached ): - Better Cross-Border Effects: Enforcement actions in the EU in relation to the same service or in respect of the same infringement should be given a cross-border effect. - Dynamic and Catalogue wide injunctions: EU legislation should ensure that right holders have a recourse to such injunctions which do not exist in most MS. - Duty of Care for all Digital Services: All digital services, which are being used to infringe copyrights, should be obliged to take reasonable steps to stop, limit and prevent infringements (“duty of care”). - Notice and Stay Down Obligation: Online hosting services of a “mere technical, automatic and passive nature” should comply with a “stay down” obligation. - More transparency, e.g. digital services should implement effective Know Your Business Customer (KYBC) policies; deterrent sanctions for non-compliance with Article 5 E-Commerce Directive; a legal basis for a database similar to the “WHOIS” database. - Better rules on damages for copyright infringements: Evidencing damages in civil proceedings should become more effective, e.g. they should be available based on a proof of sample; increased availability of lump sums or statutory damages.
