Response to Delegated Act on the provision applying as from January 2026 of the amended Fisheries Control Regulation

The comments on COMMISSION DELEGATED REGULATION supplementing Council Regulation (EC) No 1224/2009 1. The regulation specifies the principles for transmitting information contained in Article 58(5) of Regulation (EC) No 1224/2009. There is very little knowledge of this regulation, or rather Regulation 2023/2842 amending Article 58, hence the poor awareness of the consequences. 2. Article 11, point 1, requires that "the recording and transmission of the minimum traceability information listed in Article 58(5) of Regulation (EC) No 1224/2009 shall be made available in a digital way using internationally recognized standards, which shall ensure both interoperability and the verifiability of traceability information exchanged between different traceability systems of different operators in the supply chain.": a. Standards have not been established. It has not even been determined whether PDF files will be accepted. b. The efficiency and reliability of the standards were not assessed. c. The "interoperability" requirement may prevent retailers and other operators from agreeing to exchange standard proposals from suppliers and manufacturers, which will require suppliers to create multiple data exchange systems for each next operator separately. d. Therefore, even consent to the use of PDF files may be ineffective in practice. e. This will also create an additional barrier to entering into contracts with retailers and other customers for new suppliers (time to adapt to customer systems and cost of implementation). f. Furthermore, there is a complete lack of interest in this topic (by storages, retailers etc), and the implementation time (until January 10, 2026) is clearly too short. 3. Regulation 2023/2842 amending Article 57 of Regulation 1224/2009, point 2, defines operators as Operators at all stages of the supply chain responsible for purchasing, selling, stocking or transporting lots of fishery and aquaculture products () This means that the new requirements apply, for example, to cold stores (storing raw materials or products) and cold stores handling pick-and-pack operations. It appears that these companies are completely unaware of the requirements described in Article 11 of the draft and Article 58 (6) and are not preparing for them. This change is scheduled for January 10, 2026. 4. ERP systems in processing plants (at least in most cases) do not transfer much of the information required by Article 58 (the category of fishing gear, the date(s) of catches for fishery products or date(s) of harvest for aquaculture products, the IMO number or, if not applicable, other unique vessel identifier of the catching vessel(s), the catch certificate(s) number(s), the name and, where available, the registration number of the aquaculture production unit) from the raw material to the product, so that this data can not be passed on. This is a huge financial and time challenge. Without specific guidelines, it is impossible to establish budgets for such changes, and the time required for change and implementation is also significant. For many operators, these will be barrier they will be unable to meet due to financial and time constraints. 5. Specific rules for the provision of information listed in Article 58 (5) of Regulation 1224/2009 (Article 11 (1)) have not been established. Systems where products are made from multiple batches of raw materials will be required to provide all IMO, the registration number of the aquaculture production unit etc. This poses a significant challenge for IT systems and data transmission. Currently, the traceability system is based on a requirement also included in Article 12 of the draft (Marking of lots of fishery and aquaculture products 2. As a minimum, each lot shall be marked with a unique identification number.) 6. Sharing information with subsequent operators regarding the names and registration numbers of producers, IMO, or the names and registration numbers of aquaculture production units

Response to Update of the food safety criterion regarding Listeria monocytogenes in ready-to-eat foods

W trakcie pracy nad zmianą rozporządzenia zabrakło konsultacji z branżą na temat konsekwencji tejże zmiany oraz holistycznego spojrzenia na temat. Zmiana spowoduje narażenie producentów na wycofanie produktu z rynku w przypadku obecności bakterii Listeria, jeżeli nie będzie można udowodnić, że Listeria nie osiągnie limitu 100 jtk/g. Nie ma wytycznych dotyczące "badań mających na celu ocenę badań wzrostu/trwałości". Akceptowane są w niektórych krajach tylko "testy obciążeniowe", choć istnieje możliwość wykonania innych badań. Ze względu na brak wytycznych nadal będą obecne różne podejścia w różnych krajach. Nadal nie jest jasne, czy konieczne jest przekonanie władz w kraju producenta, dystrybutora czy rynku.
