Response to Delegated Regulation amending Annex I of Regulation (EU) 2023/1115 (EU Deforestation Regulation)

On behalf of the Coalition on Sustainable Timber, we welcome the opportunity to provide feedback on the Annex I the Deforestation Regulation. We fully support the EUs commitment to combating global deforestation and forest degradation, and we offer the following recommendations to enhance the effectiveness, fairness, and inclusiveness of the Regulation. We recommend introducing a simplified due diligence process for producers operating under internationally recognised sustainable forest certification schemes, such as PEFC and FSC. Both schemes have undertaken tremendous efforts to align with the EUDRs requirements, including traceability, legality, and sustainability. The EU should recognise these efforts and collaborate with these schemes to advance EUDR implementation leveraging on third-party annual audits conducted by these schemes. This would reduce burden for already-compliant suppliers and incentivizes sustainable forest certification. We propose the establishment of an EU-recognised compliance testing mechanism that would enable products to be verified through laboratory or third-party testing (e.g., species identification, origin tracing) as an alternative compliance route. This would particularly benefit producers who face challenges in providing full supply chain documentation, while maintaining the integrity of the regulation through scientific verification. We encourage the Commission to provide technical assistance and access to species identification services (e.g., through accredited laboratories or reference databases). This would prevent unintentional non-compliance and build the capacity of smaller exporters to meet regulatory requirements confidently and accurately. We recommend the EU establish a clear framework for the recognition of national or regional timber legality assurance systems (e.g., TLAS). Several countries are already in the process of updating their systems TLAS to meet EUDR standards.Providing a path for mutual recognition will reduce compliance duplication, support legal trade, and encourage governments and industries in producer countries to invest in robust governance systems aligned with EU objectives. These recommendations are intended to ensure that the EUDR is both ambitious and implementable, especially for small and medium non-EU producers that play an essential role in sustainable forestry and rural economies.
