Response to Evaluation of the Public Procurement Directives

As one of the leading European steel producers for construction and infrastructure, we welcome the European Commission's initiative to revise the directives on public procurement. Construction and infrastructure are key sectors of the European economy, and the materials used and procured by public authorities should indeed drive demand for sustainable products based on sound, transparent, and indisputable criteria. 1/ In this regard, we emphasize that environmental criteria should always be grounded in scientifically robust metrics, supported by internationally recognized and mature standards. For construction materials such as steel, the European standardization framework built around the EN 15804:A2 standard is already widely accepted and implemented, including in ambitious national sectoral regulations like France's RE2020. It is also applied internationally. Furthermore, the recently revised Construction Products Regulation and the CPR Acquis process use the EN 15804:A2 standard as the basis for environmental evaluations related to Environmental Product Declarations (EPDs). 2/ More broadly, life-cycle assessment (LCA) methodologies are well-suited to guiding environmental criteria, provided they adopt the cut-off methodology and focus on the cradle-to-gate scope, which accurately represents emissions from the manufacturing stage. In this regard, we are concerned about the current approach to recycling in the Product Environmental Footprint (PEF) framework developed in Europe. We believe that certain parameters should be revised to better align with and bridge the EUs decarbonization and circularity objectives. 3/ Since the vast majority of steel for construction in Europe is already produced via the Electric Arc Furnace (EAF) route using recycled steel, adopting alternative and non-consensual methodologiessuch as the so-called sliding scalerisks distorting sustainability evaluations. This could ultimately favor the substitution of recycled products with less sustainable ones, regardless of their actual carbon footprint or recycled content. Additionally, given that direct reduction technology for steel production is less developed in Europe compared to other jurisdictions, such distortions could unfairly benefit non-European production despite its potentially higher environmental and climate impact. We therefore recommend adopting a prudent approach when considering various options for lead market design and are eager to engage with the Commission on these aspects.
