Response to Standard Essential Patents

Sisvel welcomes the opportunity to share its perspective on the proposal by the European Commission for a regulation on standard essential patents. We acknowledge that the Commission has concerns about lack of transparency and inefficiency in SEP licensing. Generally, we share them. That is why our mission to bring licensors and licensees together is underpinned by both. Our deep understanding of and experience in the SEP ecosystem shows us that regulatory intervention is not appropriate. It introduces significant uncertainty and would hamper Europes economic development and strategic autonomy, potentially even driving innovative activity out of Europe. We believe that market-based patent pools are the solution to the transparency and efficiency concerns. We are concerned that the Proposed SEPs Regulation places Europes strategic autonomy at risk, breaches fundamental and constitutional rights, is highly impractical and is a threat to R&D and Innovative activity in Europe. We elaborate further on these concerns in the attached document. We remain available to engage in further discussions regarding these concerns.
