While there have been improvements since the current work on standard essential patents began in 2017, important challenges continue to exist. This results in uncertainties at a time EU companies are facing increasing competition at a global level. The initiative could combine legislative and non-legislative action. It will create an efficient and sustainable framework with continued participation in standardisation of innovators as well as access to standardised technology by companies.
