Response to Fitness check of how the Polluter Pays Principle is applied to the environment

We welcome the opportunity to give feedback on this very important issue. In our opinion the polluter pays principle should not be applied in generic ways, but should be individualized for each subject as much as possible, based on the actual conditions. We believe that there are cases when the subject to whom the responsibility for pollution is assigned, is not always the only one in whose responsibility the pollution occurred (e.g. the general economic interest principle applied in Nováky Power Plant). The recultivation of polluted areas can also be influenced by what is planned to be done subsequently on selected areas. We are referring to our photovoltaic projects planned on sludge bed areas. We would like to point out that in the case of EU funds for recultivation projects which ensures development of polluted areas and implementation of projects, e.g. new renewable energy sources, such recultivation projects should be entitled to receive EU funds at least in part, and the polluter pays principle should be lifted.

Slovenské elektrárne, a. s., welcomes the initiative on establishing the delegated act setting the legislative framework for facilitating and fostering sustainable investments by proposing the technical screening criteria for climate change mitigation and adaptation.
