Response to Implementing Act on non-price criteria in renewable energy auctions

Sunfire welcomes the opportunity to provide feedback on certain secondary legislation to the Net-Zero Industry Act (NZIA), esp. the draft Implementing Act on the specification of non-price criteria in renewables auctions. We would like to submit a number of key aspects, hoping they can guide the European Commission in the further drafting of the NZIA secondary legislation: Simplification of the applicability of non-price criteria; Streamlining non-price criteria under NZIA with existing criteria in adjacent policy fields; Clarification of origin to demonstrate compliance with non-price criteria; and Ensuring the uniform application of non-price criteria at Member State level. Dear Sir or Madam, Established in 2010 and based in Dresden, Germany, Sunfire is a world leading industrial electrolysis company working to deliver on the promise to create a world without fossil fuels. From that perspective, we strongly welcome the Commissions proposal to revise the free allocation rules to include also hydrogen generated from renewable electricity. We consider the proposal an important step towards a ramp-up of the hydrogen economy that will be an important step towards climate-neutrality, especially in so-called hard-to-abate industrial sectors. We want to emphasize two important factors that we endorse: 1. Removal of the exchangeability factor Renewable hydrogen shall not come be at a disadvantage compared to fossil hydrogen. This is achieved by the proposed step and justified with the general decarbonization targets of the EU. This is explained in (3) of the recitals. 2. Application from 2024 on The Delegated Regulation shall enter into force in 2024 and new entrants should be eligible for free allowances as of 1 Jan 2024. Fast implementation is crucial to achieve the EUs ambitious hydrogen targets.
