Response to Circular Economy Act

Techniek Nederland is the Dutch trade association for technical service providers, installation companies and installers, and electrical engineering retailers and repairers. This paper provides perspective on Techniek Nederland's response as feedback for the public consultation on the Circular Economy Act. Techniek Nederland and its members do support the European Commission's chosen course of action to achieve a circular economy in the EU. Please find attached our feedback paper.

Response to EU label on product durability and EU notice on consumers’ legal guarantee rights

Techniek Nederland is the Dutch employers' organization representing approximately 6,000 companies in the technical service and installation sector, the repair and refurbish sector and the technical retail sector. Techniek Nederland welcomes the Commissions initiative to develop visuals which in particular will support transparent consumers information and the consumers awareness of sustainable consumption at the same time. Techniek Nederland fully supports the overarching goals such as preventing misleading environmental claims and improving access to product durability information. Response to Sustainable products - disclosure of information on unsold consumer products

Techniek Nederland is the Dutch employers' organization representing approximately 6,000 companies in the technical service and installation sector, the repair and refurbish sector and the technical retail sector. Techniek Nederland has expressed its support for a ban on destruction of unsold goods in the initial decision-making on ESPR (and long before that). The initiative clearly fits with our views on circular working and the preference of repair, refurbishment, overhaul and re-manufacturing (working higher up the R-ladder). From practice, from shop floors and workshops, we endorse the great importance of discouraging the practice of (premature and unnecessary) destruction. Please find attached our views.

Response to Revision of EU rules on late payments (Late Payments Directive)

Techniek Nederland is the Dutch national business association of technical service providers, installation companies and the electrical retail sector. We represent approximately 6,000 companies and we are one of the largest employers' organisations of The Netherlands. On the proposed Regulation by the EC reviewing the Late Payment Directive, we do have our concerns on the proposed payment terms that removes the ability for companies to agree payment terms beyond 30 days. As The Netherlands already have a very strict regime on payments of SMEs by larger companies, it is a legal and yet a rhetorical question, which is the actual and factual problem to solve by an even more strict Regulation? The proposed Regulation undermines contractual freedom by imposing this strict 30-day cap. Techniek Nederland supports the position, as expressed by EuroCommerce. It underlines the negative consequences the Commissions proposal will have on enterprises within the EU. In the perspective of retail businesses the proposal will affect the established practices which rely on negotiating payment terms that offer advantages to all parties, particularly for products that sell over longer periods, such as consumer electronics and or heating/cooling systems. In any value chain, being able to freely negotiate payment terms is crucial. Retailers and installers do have to order goods months in advance before selling them and agree payment terms with their suppliers to remain competitive. By imposing a strict term of 30 days, the proposed Regulation will deprive businesses of the flexibility to enter into mutually beneficial arrangements. It also will cut off supply chain financing, taking away a positive form of finance that fills the gap for companies who struggle to find affordable traditional bank finance. This proposal will have a significant impact on the competitiveness of one of Europes essential ecosystems and its contribution to local jobs and communities. It will limit retailers and installers ability to offer choice and good prices to consumers. It also risks jeopardising the support given to the millions of value chain partners that are in fact SMEs. The Late Payments Directive revision poses significant problems for the retail sector given the practice of inventory financing. According to this revision retailers will have to 100% prefinance their inventory. Banks nor investors tend to finance inventory. As for the food retail sector it might be (but is probably not) feasible since most products are sold within 30 days. However, on the non-food side this poses significant problems, since revenues on sold products are usually not made within the first 30 days. This poses a liquidity problem for all companies in the retail ecosystem and indeed will pose new challenges regarding to secure financing by banks. This will affect all sizes of companies, specifically SMEs which traditionally have less liquidity. Finally, as EU businesses we have to keep in mind that third countries might not have implemented a 30-day limit, which might make companies from these countries more attractive for retailers and importers. And moreover, very large third country companies, even large multinationals may easily masquerade as SMEs in business and fiscal practice under national law, thereby profiting of this very strict Regulation, creating an uneven level playing field, which goes against the rules and spirit of the Internal Market.
