Response to Digital Fairness Act

The Together Against Counterfeiting Alliance (TAC) welcomes the opportunity to contribute to the European Commissions Call for Evidence on the proposed Digital Fairness Act. We support the Commissions ambition to tackle manipulative digital practices that distort consumer choice, enable the sale of counterfeit goods, and undermine trust in the digital single market. In particular, we welcome the focus on commercial tactics such as dark patterns, deceptive pricing, and undisclosed influencer marketing - tools increasingly used by illegal traders to promote and sell counterfeit products online. The TAC Alliance represents over 100 companies across all sectors of the economy, supported by 20 trade associations and NGOs. We are a cross-sectoral coalition committed to confronting the growing threat of counterfeiting in the EU. Our members bring first-hand expertise in identifying and addressing the sale of counterfeit goods online and have deep knowledge of the risks these goods pose to consumer safety, legitimate businesses, and society as a whole. In our submission attached, we outline key challenges linked to the persistence of counterfeit products in the digital space, the importance of enforcing existing legislation such as the Digital Services Act, and targeted recommendations to ensure that the Digital Fairness Act delivers a fairer and safer environment for consumers by contributing to the fight against counterfeiting. We look forward to supporting the Commissions work and contributing to the development of a framework that complements existing rules and strengthens consumer protection in the online marketplace.

Response to Consumer Agenda 2025-2030 and Action Plan on Consumers in the Single Market

The Together Against Counterfeiting Alliance (TAC) welcomes the opportunity to contribute to the new Consumer Agenda for 2025 to 2030. Particularly, we welcome the Commissions recognition of the evolving risks consumers face in todays market. Protecting consumers requires not only strong enforcement and safety rules, but also action to address the systemic drivers of illicit trade, particularly in digital environments. The TAC Alliance represents over 100 companies from all sectors of the economy with significant experience in identifying and tackling sales of counterfeit goods, supported by 20 trade associations and NGOs. We are a cross-sectoral coalition committed to confronting the growing threat of counterfeiting in the EU. Our members are united by the urgent need to address the harms that counterfeit goods cause to consumers, legitimate businesses, and society as a whole. In our attached contribution, the TAC Alliance sets out concrete proposals to strengthen the EUs consumer protection framework and respond more effectively to the sale of counterfeit and unsafe products online. We look forward to supporting the Commissions work and contributing to a strategy that delivers a safer and more reliable Single Market for all.

Response to Single Market Strategy 2025

The Together Against Counterfeiting (TAC) Alliance, representing 100 companies across all industry sectors, supported by 20 trade associations and NGOs, calls on policymakers to take immediate and decisive action to tackle the rising threat of counterfeiting in the EU. Fighting counterfeit is a key element to improve the single market and EU competitiveness on the global stage, as IP protection and enforcement allow for its proper functioning and thus should be ensured even through cross-border movement of goods. Companies with intellectual property rights (IPRs) generate 23.8% more revenue per employee compared to those without. When adjusted for factors such as industry, company size, and location, this revenue advantage rises to 41%, with SMEs benefiting even more significantly. This underscores the critical role of IPR protection in fostering innovation, economic growth, and a well-functioning Single Market (European Union Intellectual Property Office (EUIPO) and the European Patent Office (EPO), Intellectual Property Rights and Firm Performance in the European Union, 09 January 2025).
