Response to Update of format of F-gas labels

Thermo Fisher Scientific, the world leader in serving science dedicated to helping its customers in life sciences research, diagnostics, and life-changing therapies would like to comment on the current relevant text under Commission draft implementing Regulation laying down rules for the application of Regulation (EU) 2024/573 of the European Parliament and of the Council as regards the format of the labels for certain products and equipment containing fluorinated greenhouse gases and repealing Commission Implementing Regulation (EU) 2015/2068. We specifically suggest to amend the proposed text of Article 1, 12(a) as follows: The label of the products and equipment referred to in Article 12(15) of Regulation (EU) 2024/573 shall, from the dates of prohibition specified in Annex IV to that Regulation, include the following text: (a) for the products and equipment referred to in points 2(b), 4, 5(c), 7(b), (c) and (d), 8(b) to (e), 9(b) to (f) and 11(c) of Annex IV to Regulation (EU) 2024/573 (FGR): Prohibited to be installed and operated unless required by safety requirements that have to be applied at the site of operation, providing space on the label to specify how to directly access specific safety requirements that make their use necessary prior to putting the equipment into operation; The reason for suggesting the proposed amendment is that we believe a detailed description of the inherent hazard and requirement establishing the necessary use is not feasible for a simple label. Rather, providing an electronic means or other internationally recognized symbol to access or refer to the detailed information is a better means of conveyance to the end user and their facility engineering teams. Instrument safety standards and other regulatory mechanisms already require unique markings to provide warnings and instructions to anyone who will interact with the equipment during installation, use or servicing of the product. Moreover, Article 12, 3(c) of the new F-Gas Regulation (EU) 2024/573 requires a product label notifying service personnel that the sealed system includes fluorinated gases, their quantity expressed in weight and in CO2 equivalent of the contained gases so that correct precautions can be taken to prevent release of the fluorinated gas to the environment during servicing. Rather than a physical label which is necessarily constrained in physical size and competing with other required markings, we believe that inclusion of the required information is better communicated via inclusion within the installation/operation manuals, other accompanying documentation, or through electronic means. The additional text from the proposed implementing act will therefore be included in the accompanying documentation for review by any surveillance authorities seeking to confirm that this specific product is still in conformance to the new F-Gas Regulation (EU) 2024/573 and the safety requirements exemptions. Recognizing the details of the applicable safety requirements that require the continued use of fluorinated gases with a GWP greater than 150 may be specific to the end use facility, a broader instruction is needed than a simple label can accommodate.
