Response to 2024 Evaluation of the European Labour Authority

Since the founding, TCO has been supportive of ELA and believes that the current mandate, and the division of responsibilities found in the regulation respecting the authoritys competence and the autonomy of various national systems, are well balanced and should be respected. The supporting, informative and capacity building missions of ELA play a key role in the monitoring of the free movement of workers. Its important that the authority continues to develop in a positive direction, in line with the authority's mission according to the current ELA regulation, which sets the framework for ELA's competence and work. ELA's supporting role for the Member States, the voluntary nature of the work with full respect for Member States competencies and the role of the parties, collective agreements and different labor market models, is vital to preserve and monitor. Having said that, a general reflection on the ELA is that it is a young authority and therefore should be allowed more time to perform and improve on its current duties to a satisfactory level before there is any point in burdening it with new ones, since that could be detrimental to the ongoing process of getting ELA up to speed. ELA was also founded during the pandemic, which was a time when practically all cross-border activity within the EU was suspended. TCO believes that the current mandate of the ELA is in line with what we perceive as the role of the authority. That is, a role where ELA works as a coordinator and information hub on cross border activities. To extend ELAs mandate further than this is combined with a great deal of risk and is also premature, from TCO:s point of view. Within the scope of the given mandate, we do however see a need for a more comprehensive information hub within the ELA, including data collection and -analysis, in order to provide Member States and social partners with vital information about agents operating in cross-border situations. We believe that there could be great advantages in fine-tuning ELAs capability to supply information to various actors that request due diligence background information. We find the system with national experts at ELA very valuable, as it gives ELA direct access to good knowledge about the systems in every Member State. To conclude, TCO believes that the ELA should be given more time to develop and perform its current duties before any big changes to its mandate are made.
