Response to Safekeeping duties of depositaries for Alternative Investment Funds

UK Finance is pleased to respond to the European Commission Delegated Regulation amending Delegated Regulation (EU) No 231/2013 as regards safe-keeping duties of depositaries. UK has three key recommendations for the European Commission, which are as follows: (i) The depositary should not be required to maintain books and records (ii) Clarification on “details of equivalent rights and obligations” (iii) Omnibus accounts permitted when custody is delegated Please see the attached file for further details on these recommendations.

Please find attached UK Finance's feedback to the Commission's review of the Cross Border Payments Regulation. UK Finance has been created by combining the activities of the Asset Based Finance Association, the British Bankers’ Association, the Council of Mortgage Lenders, Financial Fraud Action UK, Payments UK and the UK Cards Association. Our members are large and small, national and regional, domestic and international, corporate and mutual, retail and wholesale, physical and virtual, banks and non-banks. Our members' customers are individuals, corporates, charities, clubs, associations and government bodies, based in the UK and overseas, served domestically and cross-border.
