Response to Cooperative, Connected and Automated Mobility (CCAM)

Leading car rental companies Avis Budget, Europcar Mobility Group and Hertz welcome this opportunity to provide feedback and will focus on the data governance aspect. We briefly touch upon cybersecurity and connectivity below. As to the scope of the Recommendation, we strongly suggest the European Commission treat connectivity separately so as to allow sufficient and targeted consideration of data and cybersecurity issues. We would also welcome an impact assessment and an integrated approach between different Commission DGs going forward. The EC strategy of 17 May 2018 rightfully acknowledges that mobility is changing but could have featured more prominently the fact that in-vehicle data will be the key currency in the new mobility market. As connected and autonomous vehicles are changing the mobility landscape, business models and ownership structures adapt and are increasingly based on data-driven services. As the deployment of autonomous vehicles will be slow and gradual, potential risks include fragmentation throughout Europe or that manufacturers become gatekeepers of such data. Instead, a level playing field must be ensured for all stakeholders involved, notably mobility providers and downstream market suppliers. The forthcoming Recommendation should therefore focus on requirements needed to foster a consumer-centred environment, driven by innovation and competition. Building on the 2015 eCall Regulation, the EC’s C-ITS 2016 Strategy and the EP’s March 2018 Resolution on this strategy, the Recommendation should outline EU action to ensure an interoperable, standardised and open platform for in-vehicle data. This should build on the work already conducted through the Commission’s C-ITS Platform, which fed back that a strong and competitive market for vehicle data-based services is optimal for today’s mobile consumers. Any future regulatory framework should be designed to avoid fragmentation horizontally (i.e. to apply in all Member States and possibly globally) and vertically (i.e. by preventing vertical monopolies). To enable analytics, drive innovation and offer a full range of innovative third-party services to consumers, car rental companies need direct and real-time access to in-vehicle data under fair and non-discriminatory conditions. This includes the vehicle (or fleet) owner’ or manager’s right to use data produced by their vehicles and to have their own means for accessing it; for instance through the vehicle’s OBD port. Such data includes, but is not limited to, fuel and odometer readings, vehicle location, safety and performance warnings, event or crash data, etc. Data protection concerns are addressed and personal data is treated according to GDPR standards. The absence of fair and non-discriminatory access on the other hand risks resulting in unfair competition, lack of innovation, vertical monopolies and a resulting decrease in consumer choice. Concerning developments in cybersecurity and connectivity, a patchwork of different Member State approaches should be avoided, as well as fragmentation between different providers which would limit options downstream. On cybersecurity specifically, it is important that security standards or certificates cannot be used as a backdoor to restricting access to in-vehicle data. Future measures should be applicable horizontally (i.e. across Member States or car brands) and accessible vertically (i.e. allow access by mobility providers and other downstream suppliers). Car rental companies are innovators and are already offering a variety of mobility solutions. We look forward to working with the Commission and other stakeholders to devise smart and future-proof solutions.
