Response to Liability rules for Artificial Intelligence – The Artificial Intelligence Liability Directive (AILD)

Upwork welcomes the opportunity to provide feedback on the proposed AI Liability Directive and to engage constructively with the EU institutions going forward. At Upwork, we believe that, together with the proposed AI Act, the AI Liability Directive will both shape the future of Europes digital transition and set a benchmark for AI liability regimes in other jurisdictions. We strongly support the decision to align the definitions in the proposed AI Liability Directive with those in the AI Act. However, we think that there should be even greater alignment and that there should be an exemption from liability for providers and users of AI where they can demonstrate compliance with the AI Act and other relevant legislation. We also have concerns about the disclosure and preservation of evidence rules, which we anticipate will be unworkable in practice, for the reasons set out in our feedback. As a result, we find the presumption of non-compliance with the duty of care if the defendant fails to disclose documents or preserve evidence in line with a court order to be disproportionate.
