Response to Digital Networks Act

Verizon is a global player. Outside of the U.S., Verizon provides a broad range of global communication products and enterprise solutions, predominantly to large business and government customers. We are established in most European Union (EU) Member States (MSs), and provide services in over 150 countries worldwide. As a pan-European business provider, we generally welcome any initiative which aims to bring further harmonisation and legal certainty, and reduce administrative burden at EU and national level. The forthcoming Digital Networks Act (DNA) presents a pivotal opportunity to establish a regulatory framework that secures Europe's digital future. The primary objective of this new framework should be the removal of existing barriers and deliver a true EU single market. Key recommendations for the Digital Networks Act include: - Harmonisation and Consistency: The DNA must maximize the harmonization of the EECC framework and ensure consistent and uniform application across the EU. This will reduce complexity and enable efficient pan-European deployment of networks and services, which is essential for an integrated EU single telecommunications market. As recognised by BEREC (BoR (24) 190), current fragmentation in General Authorization (GA) requirements among member states, where the discretion and interpretation of conditions are left to individual Member States, leads to unnecessary administrative burden for operators. Harmonizing and simplifying reporting obligations, for example, would streamline compliance processes and improve automation. - Simplification and Proportionality: The regulatory framework needs to be modernized by removing unnecessary burdens that stifle innovation and impose disproportionate compliance costs. Reporting obligations should be streamlined, simplified, and their frequency reduced. - Shift Towards Light-Touch, Horizontal Regulation: The DNA should adopt a light-touch, horizontal, and technology-neutral regulatory approach across the entire digital ecosystem. Competition law and, only where and when needed, justified ex-ante regulation should be relied upon to foster competition and investment. Sector-specific mandates should only be used as a last resort when strongly justified by an impact assessment. - Horizontal Environmental Regulations: Verizon advocates for a horizontal approach to environmental regulation, relying on the existing horizontal EU ESG frameworks rather than creating additional and duplicate new telecom-specific rules. - Recognizing Specificities of Enterprise Services: The DNA should acknowledge the distinction between retail consumer services and services provided to large enterprise and public sector customers. Enterprise services, different from consumers and small and micro customers, characterized by complex solutions with bespoke bi-laterally negotiated contracts and SLAs, should be explicitly exempt from consumer protection regulations. - Encouraging Voluntary, Industry-Led Global Standards: The DNA should encourage voluntary, industry-led global standards to foster innovation, interoperability, and global competitiveness, rather than imposing rigid, top-down technical mandates. This approach allows flexibility, promotes innovation, and prevents regional silos by enabling seamless integration with the global digital ecosystem. By incorporating these principles, the DNA can provide a clear, consistent, and forward-looking framework to unleash the full potential of the European telecommunications sector and achieve a truly connected and competitive Digital Single Market.
