Response to Revision of EU antitrust procedural rules

As a company operating in the cosmetics and nail industry, we would like to highlight a practical case that, in our view, leads to significant distortions of competition and should be taken into account in the revision of the EU antitrust procedural rules. Problem In our market segment, we have observed for years that certain manufacturers and distributors label cosmetic products (e.g. UV gels, light-curing polishes) with the notice for professional/industrial use only, while in practice these products are freely sold to end consumers. This leads to three major problems: 1. Unfair advantage: Compliant companies that properly register and label their products for consumer use are put at a disadvantage. 2. Cost savings and preferential position: Companies misusing this labelling avoid regulatory requirements and thus gain an unlawful price and market advantage. 3. Health risk: End consumers receive products not intended for private use, creating potential safety risks and undermining trust in the entire sector. Relevance for the revision The European Commission itself stresses in the consultation document that there is a risk of fragmented enforcement where stricter national rules apply. Our example clearly shows that such fragmentation is already leading to distortions of competition in the internal market: while some Member States address the misuse of this labelling, in others it remains largely unchecked. Proposal We therefore recommend that the revision should ensure that: the Commission can intervene more effectively where national differences in enforcement lead to systematic market distortions, clear coordination mechanisms between the Commission and national authorities are established, complaint mechanisms for affected companies are simplified and accelerated. This will help guarantee fair competition in the internal market, including in sectors with many small and medium-sized enterprises.
