Response to Evaluation of the Motor Vehicle Block Exemption Regulation

Increasing connectivity and automation brings a substantial shift in mobility, which allows vehicles to communicate with each other, other road users and the road infrastructure. Progress in the field of digitalisation and artificial intelligence opens up an entirely new level of cooperation within the automotive supply chain. Digitised automotive services will make mobility safer, more accessible and sustainable. Drivers shall freely decide with whom they share their data. It is therefore essential that the European regulatory framework introduces data autonomy for European citizens. Accordingly, the European regulatory framework shall provide for an open, standardised and interoperable access to in-vehicle data for all economic operators upon consent of the drivers. This view is supported by the European Parliament in its report on autonomous driving in European transport (2018/2089(INI)) from 15th January 2019. The European Parliament requests fair competition in the in-vehicle data market. Particularly, it stated that in a digitised automotive services market, direct and timely access to data and functions in the vehicle will determine whether the market for automated and combined mobility services will be subject to fair competition and independent economic operators play a very important role throughout the automotive supply chain, including after-sale services, such as insurance. The European Parliament further stressed that competition on the single market in the autonomous vehicle servicing industry could be put at risk, if manufacturers make it difficult for independent economic operators to access the systems installed in these vehicles. Therefore, digitised automotive services should be subject to the provisions of Commission Regulation 461/2010.
