The Federation of Austrian Industries (Industriellenvereinigung, IV) is the voluntary and independent organisation, representing the interests of more than 4.500 member companies in the manufacturing sector, credit and insurance sector, infrastructure and industry-oriented services in Austria. On a European level, the Federation of Austrian Industries is a member of BusinessEurope. IV supports measures to respond to environmental challenges. However, it also needs to be emphasised that, amid the COVID-19 outbreak and induced social and economic crisis, a ‘business as usual scenario’ is not possible. It is imperative to include the COVID-19 consequences on business sectors into assessments and to base the consultations’ results on reliable data and reality checks. The Federation of Austrian Industries (IV) welcomes the aim of the EU Commission's action plan to mobilise investments to promote sustainable growth. Making additional capital available for ecologically sustainable activities is essential to achieve the European climate goals. As the Taxonomy will greatly impact investment activities in companies and infrastructure, it is of paramount importance that the Taxonomy criteria for all six Taxonomy objectives be defined in a clear, practicable and incentive-compatible way in order to support the financial market and the real economy in their sustainability efforts. We count on the European Commission (EC) to consider businesses’ potential for transition as well as their need for supporting accompanying measures in order to reach climate targets. In its current form, the Draft Delegated Act does not sufficiently promote industrial innovation, therefore IV urges the EC to revise the draft and implement necessary changes.

Response to Commission Delegated Regulation on taxonomy-alignment of undertakings reporting non-financial information

The Federation of Austrian Industries (Industriellenvereinigung, IV) is a voluntary and independent organisation representing the interests of more than 4.500 member companies in the manufacturing sector, credit and insurance sector, infrastructure and industry-oriented services in Austria. On a European level, the Federation of Austrian Industries is a member of BusinessEurope. The Federation of Austrian Industries (IV) welcomes the aim of helping undertakings, financial intermediaries and end-investors to enhance capital flows towards environmentally sustainable projects and activities. Making additional capital available for sustainable activities is essential to achieve the European climate goals. In any case, initiatives that aim at establishing a legislative framework for reporting obligations as well as other initiatives directly affecting companies have to be assessed with caution. An appropriate assessment of impacts foreseen to accompany this initiative is highly welcomed by IV. IV asks the Commission to consider the following points when developing the delegated acts: 1. Consider companies’ priority to respond to COVID-19 impacts 2. Avoid disproportionate burdens 3. Simplification and clarification of obligations 4. Keep flexibility in reporting through market-driven approaches 5. Avoid ‘brown-listing’ of economic activities and facilitate investment flows towards all transition and enabling activities The Federation of Austrian Industries stands ready to provide further input on the Commission’s plans and will continue to provide feedback as these plans develop.

In order to make the European transport sector more resilient and sustainable, it is important to emphasise that the mobility and energy infrastructure as a whole need to be adapted, modernised, and expanded. Public, private, personal and non-personal data is a crucial resource for European companies’ competitiveness, innovation power and sustainability ambitions. The measures to be taken as part of the data strategy should encourage and facilitate technological developments in companies. It should be ensured that European investments channelled towards the data economy create substantial added value within Europe. The Federation of Austrian Industries (IV) welcomes the ambition to transfer to a sustainable economy supported by low-carbon modes of transport and supports regulation that benefits companies due to greater legal certainty and less administrative burden. In order to make the European transport sector more sustainable, it is important to emphasise that the mobility and energy infrastructure as a whole need to be adapted, modernised, and expanded. IV asks the Commission to consider the following points when developing the proposal for a regulation for new European emission standards: 1. Focus on implementing the 2030 targets 2. Response to Report on the application of the General Data Protection Regulation

As the voluntary and independent representation of the Austrian industry and its related sectors, the Federation of Austrian Industries (Industriellenvereinigung – IV) promotes an attractive business location boasting competitive framework conditions so companies and employees can work successfully in Austria and Europe. A federal organisation, nine regional groups and the Brussels office represent the issues of its currently more than 4,400 members in the manufacturing sector, banking and insurance as well as infrastructure and industry-oriented services in Austria and Europe. Information security and data protection must be guaranteed in the European market and respective European regulation should always ensure international competitiveness. The GDPR should therefore create a strong basis with the utmost legal certainty. The Federation of Austrian Industries (IV) welcomes the EU Taxonomy and the aim of the EU Commission's action plan to mobilise investments to promote sustainable growth. Making additional capital available for ecologically sustainable activities is essential to achieve the European climate goals. In any case it has to be avoided to hinder the recovery of the full variety of European economy after the COVID-19 crisis by this instrument. However, defining technical screening criteria for economic activities has wide-reaching implications for the whole industry. Thus, technical screening criteria have to be well-considered and determined with caution. IV asks the Commission to consider the following points when developing the delegated acts on climate change mitigation and adaptation: 1. Considering companies’ priority to respond to COVID-19 impacts 2. Avoid ‘brown-listing’ of economic activities 3. Facilitate investment flows towards transition and enabling activities 4. Response to 2030 Climate Target Plan

Please find IV's full position paper with a more detailed explanation on the following points in the attached document. Amid the Covid19 outbreak and crisis, a "business as usual scenario" is not possible. Consultations and initiatives foreseen in the Commission’s Work Programme that are not essential to fighting the current crisis should be temporarily postponed. This deferral should not change the proposed measures’ content, however, it will allow policy-makers to include the Covid19 consequences into their assessment allowing them to base the consultations’ results on reliable data. This suggestion covers a number of new initiatives, which are highly important for Europe’s future, but that are not necessary now to deal with the Covid19 crisis. One example is the Commission’s plan to conduct an impact assessment on the 2030 targets. If the Commission proceeds with this plan regardless, it would fall short in taking the unfortunately likely severe Covid19-consequences on Europe’s economy and society into consideration. The assessment’s results would not be based on reliable data and therefore, could not serve as a dependable basis for further (regulatory) actions. IV therefore urges the Commission to prioritise vital projects and initiatives to fight Covid19 instead of continuing with a “business as usual scenario”. The European Union only recently adopted legislation to reduce greenhouse gas emissions by 40% until 2030 compared to 1990 levels. This is the most ambitious target among the world’s major economies while the EU only accounts for 10% of global emissions. In 2018, the European Commission proposed that the EU should become climate-neutral by 2050, which was endorsed by the European Parliament, but is still pending approval by the European Council. The Federation of Austrian Industries (IV) stands behind the EU’s target to reduce greenhouse gas emission by 40% until 2030. The recently established framework with targets on renewable energy, energy efficiency as well as other sectoral policies would even reduce emissions by around 45% until 2030. IV asks the Commission to consider the following points for effective climate action until 2030 and beyond: 1. Focus on implementing the 2030 targets. 2. Avoid carbon and investment leakage. 3. Provide predictability and investment security. 4. The EU emissions trading system (ETS) is an effective and ambitious tool to reduce greenhouse gas emissions from the European manufacturing and energy sectors by controlling the number of issued emission certificates. The current system works well. 5. Work towards a global level-playing field. 6. Ensure security of supply and affordable energy at competitive prices. 7. Meet Increased investment needs and establish ideal investment conditions. 8. A strong economic pillar is a prerequisite: The need for a strong future-oriented and ambitious industrial strategy. Response to Carbon Border Adjustment Mechanism

The Federation of Austrian Industries (IV) acknowledges the political relevance of a Carbon Border Adjustment Mechanism (CBAM) as well as the European Commission’s intention to prevent that less-ambitious international partners undermine the EU’s climate ambition. Given the fact that the EU only accounts for 10% of the world’s greenhouse gas emissions, it is essential for the EU to complement its already ambitious climate targets with measures that create a global level-playing field for its companies, especially when they are interacting with Europe’s main trading partners. Designing a CBA mechanism will be politically challenging. The process needs to be systematic, well-thought through, and possible consequences need to be assessed, analysed and if deemed negative, mitigated thoroughly. It is pivotal to incorporate the following guiding principles into a possible CBA mechanism’s design: 1. A possible CBA mechanism must not substitute current carbon leakage measures! Such an approach is highly problematic and could jeopardise the tool’s legality as well as its effectiveness. 2. A possible CBA mechanism must be in accordance with World Trade Organisation rules and other international obligations of the EU (e.g. United Nations). 3. The EU’s supply with critical raw materials and semi-finished products must be guaranteed. Questions raised in the EC’s Inception Impact Assessment: Q1 EC Inception Impact Assessment: Type of policy instrument: A potential CBA mechanism should be built on an extended import-ETS model. Q2 EC Inception Impact Assessment: Methodological approach: A CBA mechanism should be based on EU ETS benchmark values for industrial processes, unless the importer certifies lower carbon content or higher CO2-related costs at origin. Q3 EC Inception Impact Assessment: Sectoral scope: A potential CBA mechanism should only be started with selected (sub-)sectors to address uncertainty and explore possible legal challenges or retaliatory measures. Response to EU implementation of the Aarhus Convention in the area of access to justice in environmental matters

A recent study by the Institute of Industrial Science on the consequences of Aarhus judgements by the European Court of Justice shows that 86 % of the companies surveyed expect significant legal uncertainty. Equally it should be contestable to carryover proceedings, as this could lead to a huge lack of investment. Therefore, the Federation of Austrian Industry warns against a supererogatory transposition, as such would be in contradiction to the principle of proportionality and Art. 173 TFEU. The EU should not disproportionately transpose (gold plate) guidelines specified by the Aarhus Convention. The existing consultation should cover the scope of the Aarhus Convention, which covers environmental law, such as in Article 9 (3) of the Aarhus Convention. The Federation rejects the findings of the Aarhus Convention Compliance Committee (ACCC) that any administrative act relating solely to the environment should be contestable. In addition, the EU Commission should be wary to generally harmonise implementation of the Aarhus Convention’s third pillar in all Member States. With regard to the distinction between Article 9 (2) and Article 9 (3) of the Aarhus Convention, a deliberate assessment of a significant environmental threshold is given, if there is no balance between environmental measures. Even in low-environmental matters, the Convention is already used as a justification to initiate legal proceedings. The Commission should therefore prevent supererogatory transposition at both EU and national level.
