Response to Amendment of the EU ETS Monitoring and Reporting Regulation (MRR) in response to the ETS revision/Fit For 55 (Batch 2)

The MRV is the principal tool at the EUs disposal to advance the science of non-CO2 effects. While other industry initiatives are to be supported, the MRV currently represents the only legislative option guaranteed to gather data from the entire sector. To advance our understanding, the MRV must ensure that accurate, comprehensive and comparable data is collected. This means gathering a representative and non-discriminatory dataset of all types of flights, including short and long-haul, intra- and extra-EU, day and night routes. It must cover all aircraft types, for instance wide-, and narrowbody aircraft. Therefore, the MRV cannot be limited to a non-representative sub-set of flights by only covering intra-European Economic Area (intra-EEA) routes. Intra-EEA flight routes account for ~25% of European aviations carbon emissions, while extra-EEA/long-haul routes account for ~75%. However, when it comes to non-CO2 effects, there are scientific reasons to suspect that the bias towards extra-EEA/long-haul routes will be even greater than with carbon. This is due to the timing and location of these flights, as more of these routes occur over global regions where weather conditions make persistent warming contrails more likely, and due to flying at higher altitudes and for a longer time. Note, there is also a higher proportion of night flights on long-haul routes. Limiting the scheme to intra-EEA flights would make the MRV blind to the vast majority of non-CO2 effects, drastically undermining the purpose and statistical validity of the data it generates, and misdirecting future action to mitigate non-CO2 effects. The aviation sector has a collective duty to lower the climate impact of flying and we cannot to do this effectively, if we limit the scope of this research and exclude the majority of EU aviation, the very areas that are most suspected of generating these effects - namely extra-EEA/long-haul routes. The most polluting flights are not captured, and therefore the most polluting business models are subjected to more lenient treatment than airlines with more efficient business models. This is not a level playing field. As for the extraterritoriality, we take note of the concern raised by parts of the industry, that the proposed scope of the MRV could create an extraterritorial impact on non-EU carriers, due to the extra-EEA/long-haul portion of the scope including both EU and non-EU operators. However, we highlight the fact that the ReFuelEU Aviation mandates the uplift of SAF for all flights departing an EU airport, regardless of the nationality or destination of the carrier. This will result in significant cost for both EU and non-EU operators, but it did not provoke any diplomatic incident. Multiple European regulations apply to non-EU carriers for extra-EEA routes. It is therefore difficult to understand why the monitoring (and not pricing) of non-CO2 emissions for scientific purposes would result in a dispute with non-EU governments. Nevertheless, the solution they proposed to address the extraterritoriality problem (i.e., making the MRV voluntary for all carriers across all extra-EEA routes) would create an unfortunate and unintentional situation, where no data is reported at all for the entire long-haul network of European aviation. This would drastically undermine the purpose and statistical validity of the MRV by obscuring the vast majority of non-CO2 effects (as these are suspected to occur on long-haul. In conclusion, leaving out a substantial number of high-emitting flights would be a mistake. From our perspective, there is no clear reasoning behind only including intra-EU flights in the data collection. It would entirely ignore the types of flights that are likely the most polluting from a non-CO2 perspective. In essence, mitigating climate change is the responsibility of the entire ecosystem. Everyone needs to play their part and there should be no exceptions in this legislative file either.
