Response to Revision of the specifications for EU-wide Multimodal Travel Information Services (Delegated Regulation 2017/1926)

YUTA - MonTiN Safe administration strongly supports a great progress of the European Commission in establishing the elements for integration of multimodal traveling in the massive everyday usage and in processes for achieving that multimodal traveling becomes the favorite journey options. Thanks to the introduced delegated regulation proposal - the multimodal traveling can be better recognized within the legislation frame. Within this feedback, YUTA - MonTiN Safe Administration strongly support proposed delegated regulation, where, also, would like to give a light about importance for establishing the coherency between multimodal agenda, Instant payment regulation, digitalisation of traveling documents and better protection of traveler's rights. For instance - during the fast mode switch, it is very important that fast re-booking is well matched with traveling documentations, instant payment service and protecting consumer's rights. In that sense, metadata of instant payment process, re - booking segment and the information system which handles digital traveling documents will contain the same sequences.Therefore, within this Delegated regulation it is possible to be recognized interoperable matching of the aforementioned metadata sets, which can help in establishing the higher level of coherency of linked agendas. Therefore, the proposal of YUTA - MonTiN Safe administration is that the European Commission considers to modify the segment: "4. Member States shall reach an agreement, in cooperation with relevant ITS stakeholders, on the metadata requirements. The data holders shall ensure that they provide the metadata on the basis of those requirements." with adding the normative that metadata need to be interoperable with metadata provided in instant payment process (or payment with Digital euro or other CBDCs) which is correlated with multimodal service and metadata gained from information system for matching digital traveling documents with multimodal traveling. Response to Enhancing the convergence of insolvency laws

The tourism sector is an ecosystem, which directly depends on functioning linked business processes and which interconnects, not just the functioning of businesses chains of different business sectors, SMEs, individual entrepreneurs, but also involves that this established business environment is organised towards the end customer, where the complete ecosystem needs to take care of preserving customer rights and prevent the abuse of the rights of some linked and involved business subjects on any level. Therefore - an efficient payment process is very vital for the resilient functioning of the tourism ecosystem, which contributes 10% to EU GDP. Late payments in the tourism ecosystem are very common, more than in any other environment (60 % of all payments in tourism arrive in late payment cycles). Therefore, insolvency of one linked subject in tourism can trigger a chain reaction and escalate in progressive liquidity and bankruptcy issues of other linked business subjects what happened during COVID -19 and post COVID -19 period. YUTA - MonTiN Safe administration is involved in the realisation of a standardised guarantee platform for the realisation of obliged business terms (within a SMART contract process) of linked business subjects, which involves SMART contract, ESCROW procedure, penalty obligation, independent referee for detecting business term(s) realisation or detecting the degree of deviation and multi payment processes. In a way if the penalty obligation is present - it prevents possible court process or process of arbitrage, therefore, indicators of success are the total number of penalty transactions, as well as the level of integrated digital insurance in daily usage 3) digital health insurance and achieved integration with other international health sectors in a way for better regulation of tourism health sector and preventing the abuse of health insurance by individual international passengers 4) established level of interconnected universities informational systems for verification of completed level of education and comparative mechanism for matching with level with similar programs on another university. Accumulation of fragility in the functioning of linked business processes, as well as the lack of efficient mechanism for preserving consumer rights and preventing the abuse of rights have a direct impact on economy stability, what was detected in COVID-19 and post COVID-19 period. Implementation of the digital guarantee service, which can ensure realization of linked business processes, preserve functioning of the supply chains (including prevention of solvency issue and prevention of the bankruptcy reflection of single subject towards other segments of supply chains), linkage of this digital guarantee insurance with Digital Euro and Instant payment in Euros - are very important for resilience of Single Market, EU monetary stability and within involvement of the guarantee service, which can be linked with Digital Euro payments and which can be used for the insurance for functioning international trade sector, harmonized European approach in contribution to global economy stability can be achieved. Coordination with OECD digital economy agenda is very important, as well as establishing standardized guarantee service for green bonds emission and controlling mechanism, which is linked with the penalty payment regime, if the obliged emission reduction is not realized. Coherency with OECD AI activities can also be very useful, in a way that involved EU AI Tools are harmonized and interoperable on a global level. This is very important for the detection of potential fraud attempts according to received information of linked international transactions. Cohesion of digitalisation of biometrics documents, data center and AI tools, which monitoring payment transactions and, additionally, if there is a linkage with guarantee service for realization of previously obliged business terms, which can confirm the reason for payment transaction and realization of the purpose, which was the base for payment transaction - a huge level of preventing crime activities can be achieved. All of aforementioned points are strategically very important topics for the EU. YUTA - within the interaction with MonTiN Safe administration, is strongly involved in placing the resilient solution for integrating the digital guarantee for functioning the linked business processes (which is the most important for the tourism ecosystem, according to the complexity of the different linked processes - for having maintained functionality and which need to be synchronized). This guarantee service can be translated to the other ecosystem. Braking functionality of the linked business processes, which exponentially increase during the crisis situation - has a great impact on risk entropy. Considering the fact that the introduced digital guarantee service gains information about all linked business processes and obligated penalty amount (in a situation for canceling the previously agreed business terms), this is a great tool for central monitoring of the efficiency in functioning the linked business processes. Furthermore - it is a great source for collecting the information about the price for cancellation of delivering the agreed terms. In a context of the regulation, where the measures for the crisis situation involves the business subjects for increasing the production of the vital products - solvency, as well as the penalty obligation and eventual sanctions, which the government sector places (if the business subjects do not increase the announced production) have a significant impact towards placing a resilient control mechanism within the crises. In that matter - if the placed sanctions are less than the penalty obligation of cancellation of the agreed service (which need to be canceled in a purpose that some subjects realize the announced production), then the control mechanism is useless. Correlating, from the one side, the similar dependency of the efficient functioning of linked business processes in tourism ecosystem and trade ecosystem, that trade sector supply chains are integral element of tourism sector, and that trade policy mesure like tax relaxation and excise refunds in transportation are linked with the traveling industry, that digitalisation of tourism can be translated in similar way for trade digitalisation, and that consumer rights protection and preventing the abuse of the rights can be implemented in the same way in tourism sector as in trade, but from other side that YUTA administration is directly involved in territorial jurisdiction of Western Balkans - YUTA administration's proposal, for the trade regulation, can be found in the attachment. YUTA - MonTiN Safe administration is strongly involved in placing the resilient and sustainable solution for repairing the fragility in the tourism ecosystem, and in placing the functional solution is strongly recognized digitalisation agenda of the European Commission and involvement of the digital payment instrument - like digital euro, which also can be involved in the trade agenda, in the same way.
