Commission Implementing Regulation on fair use, based on typical usage patterns, and anti-fraud measures for the intra-EU communications defining the technical conditions concerning fair use and anti-fraud measures, which providers may apply when voluntarily offering retail tariffs in line with Article 5a of the Open Internet Access Regulation as modified by Article 17 paragraph 8 of the Gigabit Infrastructure Act Regulation and thereby being exempt from the retail caps.
