Response to How to master Europe’s digital infrastructure needs?

Vodafone calls for a Connectivity Union to secure Europe's digital ambitions.<br>The EU faces a unique set of challenges for its digital ambitions: i) a large investment gap jeopardising the EU's digital transformation, ii) the lack of a Single Market and the associated scale benefits - due to the fragmentation of rules between Member States and within different parts of the digital ecosystem, iii) an innovation by permission approach which has led to the EU being a net importer of innovative solutions that come to market. Fixing Europe's digital infrastructure is critical. As the Commission rightly acknowledges, the future competitiveness of all sectors of Europe's economy depends on advanced digital networks and services. 5G standalone and the integration of the Internet of Things (IoT) and artificial intelligence (AI) in the network and devices will allow for a symbiotic relationship between content, connectivity, connected devices and the data they generate - unlocking new applications and solutions at scale, propelling a new era of productivity growth and industrial transformation, so-called industrial internet. But for this the EU must address its laggard status on 5G standalone deployment. Connectivity must not become the AI bottleneck. We also welcome that the Commission has identified some of the key problems that need solving, including the excessive fragmentation and costs borne by the telco sector, and an asymmetric treatment of players in the ecosystem, which ultimately has led to the EU facing a serious competitive disadvantage globally. This has put the achievement of the Digital Decade targets at risk, with major implications for the twin digital and green transitions. However, the Commissions White Paper falls short of proposing the much-needed comprehensive set of policy reforms, including on competition and spectrum policies, and injecting the right sense of urgency. Much more will be required to restore investor confidence in the EU, especially in relation to concrete and timely policy actions. In the paper attached, we call for a more ambitious EU reform agenda through the establishment of a Connectivity Union, reflecting our vision for the future of the industry. We identify the need for an urgent overhaul of the current framework, with the adoption of a new pro-investment, pro-innovation policy approach that: - Stimulates investment competition; - Ensures fair competition across the digital ecosystem by treating all actors consistently; - Ensures coherence between the intertwining aspects of economic regulation, security, resilience, open digital sovereignty, and sustainability; - Promotes simplification and ends the piecemeal approach to policy and legislation; and - Unleashes the benefits of the Single Market. Specifically, in responding to the White Papers 12 scenarios, we have identified five policy priorities for a new European Digital Communications Framework, required for the Connectivity Union: 1. Scale and Market Structure: Investment competition in mobile and fixed markets, and removing barriers to the provision of pan-EU business services. 2. Spectrum: Pro-investment policies, giving operators long-term certainty over their spectrum holdings. 3. Same Service Same Rules: A policy framework promotes technological innovation. 4. Security and Resilience: Better protection through risk-based, proportionate, vertically harmonised approach, implemented in consultation with industry. 5. Sustainability and Social Responsibility: Incentivising sustainability efforts by improving the investment environment, with all stakeholders committing to sustainability, economic and societal responsibility. We are convinced that through such a Connectivity Union, with the right level of ambition and sense of urgency, the EU has a chance to get the best-in-class digital infrastructure that its citizens and businesses deserve and to re-establish itself as a continent for innovation and investment.

Response to Revision of the Broadband Guidelines

We welcome the opportunity to provide input to the roadmap for the revision of the State Aid Broadband Guidelines. This revision is very timely to bring the 2013 guidelines in line with the new connectivity ambitions set by the EECC, Digital Compass and other EC priorities. While we believe that the elements mentioned by the EC that require adjustments are broadly correct, precise guidance is needed in some of them so that available funds are used efficiently Public funding for mobile networks Regarding the guidance on the support for the deployment of mobile infrastructure we believe that the EC should try to go beyond current case practice as suggested by the roadmap. The 2013 guidelines were written principally with fixed wireline infrastructure in mind, which in turn dictates a focus on the need for funding to be directed to passive infrastructure. The current case practice has focused on passive infrastructure and this should not be applied by analogy to wireless networks, where the role of active infrastructure is integral to enhanced performance. The concept of step change in mobile networks should be clarified and the upcoming guidelines should recognise that each generation of mobile technologies represents a step change compared to the previous generation e.g. 5G is a step change compared to 4G. In the future all geographic areas should have access to best in class (transformational) 5G and therefore mere incremental upgrades to current technologies (e.g. dynamic spectrum sharing) should not be supported through public funding. Qualified technology neutrality We urge the EC to align the State Aid rules with the EECC and provide guidance on how to deploy publicly funded VHCN in a neutral manner. The guidelines should not be used to overwrite the EECC by introducing new technical parameters that in the short run could only be met by one specific type of infrastructure. It is key that the EC applies the principle that State aid should be granted in favour of Gigabit-capable broadband deployment, irrespective of its technology. This would underpin the Digital Compass strategy as well as tackling the distortive effect of dominant operators leveraging fully amortised and outdated network assets (in State aid funded deployments. It would also give the market a strong incentive to use the wider range of available technologies capable of providing Gigabit download speeds. Overbuilding Overbuilding current or planned networks, unless they are poor quality or low speed, is never an appropriate use of public funds. While there must be no overbuilding of networks that enable 1 Gbps download speeds, State aid should also not be used to reinforce already dominant positions. The upcoming rules should be used to mitigate the risk of overbuilding by imposing ex ante conditions upon dominant operators that receive aid. These could include: restrictions against crowding out private investment in competitive areas and undermining a competitor's deployment through overbuild. Access to publicly funded networks owned by dominant operators In many EU markets, State aid measures for broadband have predominately favoured dominant operators. This perpetuates dominant operators’ existing advantages and exacerbates distortions of competition. The State aid framework should be explicit and prescriptive in mandating adequate network access as a pre-condition to dominant operators receiving aid. In order to prevent delaying tactics, conditions for access to the infrastructure of a dominant operator should be clear and access should be readily obtainable in practice. Consultation on the draft guidelines The consultation on the draft guidelines is a key milestone to set the State aid framework for the next decade. It is expected to include for the first time guidance on how to use public funds for the deployment of mobile networks. We would appreciate if stakeholders could benefit from a longer period to provide input to the draft guidelines.

The Covid pandemic has reinforced how crucial connectivity and digital services are for everyone - they have minimised the sense of social isolation, enabled online family gatherings and celebrations and helped to manage interruption to work and access education for many. However, still many children have had no access to education as they didn’t have a laptop or connectivity and many older and vulnerable members of society were unable to access services and receive medical care online. On the other hand, being constantly online has brought more focused reflections on our personal relationship with connectivity and the impact of digital tools and platforms on our societies and democracies, such as hate speech, incitement to violence, disinformation, destabilization strategies, cyberbullying, unfair competition or increased scrutiny of customers’ use of tech. As a result, people can feel threatened and less empowered as part of a digital society that needs to work for all. As the largest pan-EU telecommunications operator with operating companies in 10 EU member states, reaching 273 million Europeans through our services, we believe in a digital society, powered by high capacity GigaNetworks connecting people and communities. We want to actively participate in shaping the ‘principles that guide the European way for the digital society’ in ways that are inclusive, have people and European values at their core, that respect the environment and support a responsible use of technology. We believe that Europe is in a unique position to make this happen by enabling values and human rights-centred digitalisation, fostering the global dialogue and cooperation regarding digital rights and global digital governance. But we need to get the basics right first. A healthy and competitive European digital landscape is contingent on pro-investment policy reforms and sufficient investments in digital infrastructure, backed up by a regulatory framework that ensures the trustworthy and human centric use of digital technology. In parallel to infrastructure investment, investing into digital skills must be a priority. Skills are the main pillar of a digital European Union: they can empower and pave the way for prosperous future, ensure resilience and adaptability to future challenges and ensure inclusive and cohesive societies. Skills can help us all to become responsible digital citizens. We stand ready to build partnerships and collaborations, with citizens, decision makers, national and local authorities, across sectors. Vodafone Group - Input to GBER Roadmap Vodafone Group welcomes the opportunity to comment on the roadmap for the revision of the GBER in view of the digital, green and industrial strategies of the European Commission. The current discussions around the targeted changes to the GBER in view of the use of the recovery and resilience facility funds for the deployment of fixed and mobile Very-High-Capacity Networks (including 5G) show that the current regulation and guidelines for broadband deployment are not fit for purpose in view of the 2030 Digital Compass targets, in particular regarding the use of public funds for the deployment of mobile infrastructure. Vodafone, therefore, supports the parallel revision of the GBER and of the State Aid Guidelines in relation to the rapid deployment of broadband networks. The revision of the GBER and the State Aid Guidelines is even more important in view of the recently announced 2030 Digital Compass targets that foresee that by 2030 “All European households will be covered by a Gigabit network, with all populated areas covered by 5G”. We very much support the fact that the Commission is not choosing technologies but rather focusing on a future-proof technologically neutral approach. We urge the Commission also applying this principle to State Aid and therefore that public funds should be granted in favour of Gigabit-capable broadband deployment, irrespective of its technology. This would underpin the Commission’s 2030 Digital Compass (and the 2025 Gigabit Society strategy) as well as tackling the distortive effect of incumbent operators leveraging fully amortised and outdated network assets in State aid funded deployments. It would also give the market a strong incentive to use the wider range of Gigabit-capable technologies now available to deploy high- speed broadband. The technology neutral approach needs to be combined with strong safeguards that ensure the efficient use of public funds. We have regrettably seen that State aid is too often used by incumbents to overbuild or threaten to overbuild networks in strategic areas, in order to target competitors’ existing or planned investments. In our view, overbuilding current or planned networks, unless they are poor quality or low speed and therefore should be replaced, is never an appropriate use of public funds and this should be reflected in the revised GBER. Finally, we believe that much more clarity should be given to public authorities and network operators that want to use mobile technologies to bridge the digital divide. The current rules on the use of public funds for the deployment of mobile technologies are not fit for purpose. Public funding will be required to bring broadband coverage both to rural areas and other critical areas (including grey and even black areas) where there is still no solid business case (e.g. industrial and economic hubs). The Commission should therefore set out the basis on which public authorities might consider State aid for 5G deployment in rural areas for example taking into account an acceleration incentive and e.g. transport corridors, business parks etc. (which may be in grey or black areas) and should clarify without any doubt that 5G constitutes a significant step change from 4G in all respects, including availability, capacity and speed.

Response to Europe’s digital decade: 2030 digital targets

We support the Commission’s vision for digitisation of Europe, its society and economy, unlocking job opportunities, leaving no one behind, achieving strategic autonomy while protecting citizen rights and the environment. Overcoming the deep digital divides - between people, businesses and communities - that the pandemic has exposed will require both public and private investment in digital, in parallel with policy reforms that will make investments profitable. We support that the new Digital Decade Targets should be aligned with the DESI framework - against which policy reforms should be measured, and progress monitored. To make these targets achievable, investment must be paired with policy reforms in order to unlock the full potential we envision. We support a holistic approach that goes beyond connectivity, and addresses digital skills, SMEs, health through digital technologies, climate, transport infrastructure, industrial data sharing, cybersecurity and vendor diversity. As Europe’s vision of future success is constantly evolving, we advocate for a flexible approach which reassesses targets every 5 years. Beyond the availability of connectivity, there is now a priority to ensure that connectivity is secure and fit for purpose as more of the economy becomes increasingly reliant on secure and reliable digital connectivity and networks are regarded as critical national infrastructure. This has major and critical implications for how networks are designed and configured, the country of origin of network equipment and how digital information is stored and protected. Delivering high quality nationwide digital connectivity is a prerequisite to a digital Europe. However, targets, of themselves, are not sufficient to delivering these targets. The EIB has already identified a €250bn investment gap, and with a return on capital employed below cost of capital, the European telecom sector, in the current environment, will not attract the additional investment needed. Setting ambitious connectivity goals needs to be accompanied by policy reform targeted at improving the environment for investors, including: 1) Allowing the sector to operate at scale, which may mean that in-market consolidation of unsustainable operators is feasible, while discriminatory spectrum auction rules that distort market structure are effectively prohibited 2) Addressing the issues of high reserve prices, artificial spectrum scarcity, discriminatory auction rules or inefficient auction design that tend to result in excessive spectrum fees 3) Implementing the Broadband Cost Reduction Directive in order to address factors leading to high network deployment costs 4) Ensuring national EMF limitations and measurement methods align with internationally accepted norms 5) Providing a coherent European framework for efficient network sharing (with appropriate competition safeguards) 6) Allocating public money to plug the investment gap, particularly in rural areas, with open access infrastructure Moreover, we elaborate on digital skills, SMEs, health through digital technologies, climate, transport infrastructure, industrial data sharing, cybersecurity and vendor diversity in the attached paper.

Vodafone is a leading telecommunications company in Europe. We welcome and strongly support the European Commission’s ambitions around building a resilient, green and digital Europe. Our motto is to ‘connect for better future’ and we are optimistic about how technology and connectivity can change the future in a positive way and make sure it does not come at the cost of our planet. We are therefore addressing our own impact while looking to support wider society to reduce theirs. We believe our connectivity solutions can support significant benefits across society, far beyond our own footprint. Our sector’s most material environment issues are energy & carbon emissions and e-waste generation. We are committed to reduce our environmental impact. Our energy use has remained flat in face of increasing data demands and carbon emissions have been falling, targeting net zero own emissions by 2030 and full value chain by 2040. This will be achieved through: investing in energy efficiency measures and renewable energy; reusing, reselling and recycling our network equipment and customer devices and challenging our suppliers’ environmental performance. We hope that telecommunication sector efforts can be reflected in the taxonomy and access to funds. We agree with the objectives of taxonomy and investments in projects and economic activities that have a substantial positive impact on the climate and the environment. In the context of taxonomy work, we welcome that rec 25 of the draft delegated regulation recognizes that ‘information and communication technologies have the potential to contribute to climate change mitigation and to reduce greenhouse gas emissions in other sectors, such as by providing solutions that may help decision making enabling greenhouse gas emission reductions’. We would like to invite the legislators to include carbon enablement technical criteria. Many of our digital and connectivity solutions support others to reduce their environmental impact or resource use. For instance, Vodafone committed to help our business customers reduce their own carbon emissions by a total of 350 million tonnes cumulatively over the next ten years, starting from 2020. IoT applications that help customers reduce emissions include: - Smart cities – networked intelligently to improve the efficiency of energy-intensive services such as public transport, public road networks and street lighting. For example, in the city of Guadalajara, Spain, 13,500 LED lights were connected to a central management system, reducing street lighting energy consumption by 68% - Smart logistics – IoT technologies embedded in vehicles to optimise route management, vehicle maintenance and driver behaviour, delivering cuts in fuel consumption of up to 30% and saving an estimated 4.8 million tonnes of CO2e. - Smart farming- Smart agriculture enables farmers to manage their crops and livestock more efficiently and sustainably through connected monitoring devices and farming equipment. Up to 10% reductions in input requirements have led to reduced damage to local environments and habitats through lower natural resource consumption and fertiliser use. Leveraging the power of connectivity and IoT in delivering the EU Green Deal is essential, and is an opportunity for Europe to be a technology leader. We have set out our own ambition to help our customers reduce their environmental impact and carbon emissions, just as we are focusing on decarbonizing our own networks. But supported by the enabling regulatory framework in the field of taxonomy, we would realize an opportunity to truly unleash the investment and power of technology, delivering greater reductions in carbon emissions in parallel with a strong economic recovery.

Response to Voice call termination rates in the EU (Eurorates)

Vodafone Group supports the policy intent of the Eurorates legislation, namely the exercise in simplifying the process across all member states. We support the Commission’s policy of harmonising approaches across the EU. We note that the EC is proposing quite significant reductions to the existing termination rate levels and reduction of the termination rates should be a policy goal where there is a demonstrable consumer/retail issue, accompanied with relevant analysis as to competition or dominance problems that need to be addressed. This is consistent with the provisions of the new European Electronic Communications Code. To date, we are unaware of any SMP or bottleneck concerns in this area, and it is generally accepted that the market is currently efficient. It would be concerning if an exercise in harmonisation inadvertently regulated an area where a retail problem has not been identified. An inadvertent consequence of such an action would likely reduce revenues across the entire industry, causing price and revenue shocks. This would be an unproductive result in an industry where margins are already in decline. Moreover, such an outcome would have a contrary impact at a time when investment by European operators in the European telecommunications markets, such as the ongoing deployment of very high capacity networks, is one of the paramount goals of the Commission. The new European Electronic Communications Code is clear in its policy intent that any departures from the way the market is operating needs to have adequate justification in terms of a demonstrable problem at the retail market. A number of Member States today are already operating at below cost, and no retail market issue is identified in the termination rates space. We therefore consider that it is important for the Commission to provide sufficient flexibility in the delegated act to ensure there are no major price and revenue shocks to the current levels of termination rates. Sufficiently long transition period of five years and glide paths are essential in this case. We also note that there are some Member States where termination rates are below the proposed cap, albeit only slightly. We ask for the Commission to clarify explicitly in the Regulation that termination rates in these Member States are allowed to increase to the harmonised level. The Delegated Act contains also provisions on calls to numbers other than geographic or mobile numbers (article 6). We note that these types of services have not been consulted in the previous stage. In most of the Member States these services have always explicitly been excluded from termination regulation, as often there are no separate termination markets on individual networks and that telecom operators in that perspective do not have a monopoly or market power. End-users can choose between competing information services, and companies that offer these services can easily switch networks. Thus, these services have not warranted regulatory intervention and consequently they should be excluded from the Delegated Act.

Response to Farm to Fork Strategy

As a company supporting a variety of European farmers with Internet of Things (IoT) applications, Vodafone commends the vision as set out in the European Commission’s overarching Farm to Fork strategy. However, we would like to emphasise that the strategy roadmap should place a greater emphasis on leveraging the role that digital technologies can play in delivering impact across food value chains by making them more sustainable and environmentally friendly. Digital technologies can help support a variety of different innovations relevant to a sustainable food system, including in relation to soil analysis, pest presence and the environment. This can lead to improvements in quality of production, better climate resilience through improved weather forecasts and more sustainable farming practices (i.e. water and input use). Data also has an important role to play in making farming practices more efficient and sustainable. For most farmers, collecting hard data from the field is still largely a manual process, involving scouting and collecting soil and plant samples. To address this challenge In Ireland, for example, we are working with the Irish Farmers Association and Remote Signals to pilot an IoT project which aims to give farmers greater insight into their soils across the farm (i.e. moisture, temperature and mapping) , leading to the optimised use of fertilisers and other inputs. In summary, we would recommend that the effective use of digital technologies in general and IoT in particular is explicitly highlighted as a relevant policy consideration as part of the Farm to Fork Strategy roadmap. We would be very happy to share more information with the Commission on this as required.

We would like to thank the Commission for having largely reflected our (and the broader industry’s) requirements in its draft implementing act. We consider that the draft implementing act implements article 102(3) of the EECC in a reasonable manner. The Commission will find Vodafone’s comments on its draft implementing regulation below. 1. Use of contract summary sheets It should be clarified, in the implementing regulation, that providers are only required to use contract summary sheets at the initial point of sale, as it would be disproportionate to require operators to provide a new contract summary sheet every time the contract is modified. 2. Maximum harmonisation It’s unclear whether Member States could introduce requirements which go beyond those which are set out in the implementing regulation. Operationally speaking, we do not believe it would be possible to provide more information than what is currently required under the draft implementing act. It would therefore be helpful if the draft implementing regulation could clarify that Member States are not permitted to require operators to provide more information than what is currently specified in said act. Moreover, it would be useful to clarify, in recital 17, that the inclusion of “an optional section on other relevant information” should be left to operators to decide, at their discretion. 3. Information on prices The Commission’s proposal, in recital 12, that “the price information for bundles should include the price for all the services provided” lacks clarity. We do not consider that the contract summary sheet should provide information on the prices at which the consumer could buy the elements of the bundle, including any terminal equipment, separately from the provider. We also don’t support the proposal that operators should provide the “total sum” for all services included, as operators don’t know in advance which elements of the bundle consumers will opt for. It would be helpful if the Commission could amend recital 12 to reflect this. Finally, it would be helpful if the Commission could clarify whether information on prices for “out of bundle” and additional services should be provided via a link to the relevant terms, or via a statement that the relevant terms will be provided separately, at the customer’s request. 4. Information on download speeds We would welcome guidance from the Commission on the specific information that operators should provide on download speeds, and it would be helpful if recital 14 specified that any information on download speeds must be concise. Moreover, we believe it would be more useful to consumers if operators provided them with “maximum download speeds” and/or “average download speeds at peak times” (at the operators’ discretion), for fixed internet services, rather than the “normally available download speeds”, as the former indicator is better understood by consumers (and more commonly used by operators) than the latter two. 5. Information on pre-paid services The reference to “pre-paid services” in recital 6 suggests that such services fall within the scope of the implementing regulation. In our view, operators shouldn’t be required to provide contract summary sheets for pre-paid offers as these are low value, consumer driven transactions with no automatic renewal. A requirement to provide such information would be disproportionate. The Commission’s implementing regulation should therefore be amended to reflect this. 6. Information on features for end-users with disabilities It should be clarified, in recital 16, that the information requirement relating to features for end-users with disabilities only applies where these are relevant to such services. 7. Presentation of content For the avoidance of doubt, it would be useful if the act could confirm that the use of corporate fonts is permitted alongside the most commonly used fonts, for brand consistency purposes.

Response to Specifications for the provision of cooperative intelligent transport systems (C-ITS)

Vodafone is committed to working closely with policymakers to ensure that Europe has rules that are fit for purpose to ensure growth of this sector and its delivery of safe and secure services to transport users. Through Vodafone Automotive, we have 900 automotive experts, are a Tier 1 supplier to the automotive sector and handle 5,500 vehicle alerts per day on average in Europe. We currently connect over 18m vehicles. We do however have material concerns with the current draft of the Delegated Act. In order to achieve the aims of the ITS Directive, it is essential that the Delegated Act recognises the services already available on the market, providing functionalities similar to Day 1 C-ITS services, using technologies outside the scope of the Delegated Act. In addition, there are essential requirements that the draft regulation fails to address, including on vital topics such as privacy, security and homologation. The stated approach to interoperability between Cellular-V2X (C-V2X) and existing C-ITS stations connected via ITS-G5 (limited as they are) is disproportionate and ignores market reality. There will be other reasons for a lack of interoperability, including on privacy grounds and where the end-user chooses not to pay for a C-ITS service. Any interoperability requirement in relation to communications technologies alone should be mutual. Safe, secure and high functioning cars also require much greater certainty regarding the use of C-V2X for C-ITS, which can of course provide both short and long range capability and ensure a transition to 5G. The current text, with its expedited approach, whilst at the same time restricting the use of C-V2X (even though it is technically mature and preferred by a number of leading European automotive manufacturers), calls into question the consistency of the Delegated Act with the Commission¡¦s own Better Regulation agenda. We therefore ask that the Commission: - Addresses the material issues with the current draft of the Delegated Act before it is finalised; - Amends the current draft to include in its scope specifications and profiles enabling the deployment of C-V2X technology both short and long-range, on an equal footing with ITS-G5, and - Strengthens the fast-track update process of this Delegated Act in order to define a clearer process and legal certainty as regards the timeline (6-month maximum before a decision is taken) and conditions for the inclusion of future technologies or services under the delegated act e.g. 5G.
