As a (local) online retail platform operating in the Netherlands and Belgium, bol.com would by means of the attached paper like to provide its views on issues 2, 3 and 4 of the IIA, since they are most relevant to our platform operations. Moreover, from these views, we will also share our preliminary thoughts on the policy options mentioned by the EC.

Response to Digital Services Act package: ex ante regulatory instrument of very large online platforms acting as gatekeepers

Bol.com welcomes the opportunity to respond to the Digital Services Act (DSA) Inception Impact Assessment (IIA) on 'ex ante regulatory instrument for large online platforms with significant network effects acting as gate-keepers in the European Union’s internal market'. As a local online retail platform operating in the Netherlands and Belgium, bol.com is pleased to share their views on the problem analysis and the introduced possible policy options. Bol.com believes it is necessary to take into account the following conditions when considering additional ex ante regulation for large gate-keeper platforms: • Explain and take into account more clearly the interplay with existing regulation, such as the Platform-to-Business regulation and existing competition law • A comprehensive analysis of online markets in order to illustrate differences between platforms and dynamics between and within online markets • Include factors as scalability and obtaining unfair competitive advantage from other markets in assessment of the gate-keeper role of platforms (Information bol.com via: M. Bol.com welcomes the opportunity to respond to the Digital Services Act (DSA) Inception Impact Assessment (IIA) on 'deepening the Internal Market and clarifying responsibilities for digital services'. As a local online retail platform operating in the Netherlands and Belgium, bol.com is pleased to share their views on the problem analysis and the introduced possible policy options: • Since 'digital services' and 'digital platforms' consist of an extensive range of business models, bol.com suggests being very specific during the further process, in order to address the right kind of problem and engineer appropriate and fitting solutions; • Responsibility and liability should be well balanced. Bol.com is against a general (product)liability for platforms. But, when a certain platform facilitates the sale of goods to consumers on the EU market, and the platform seller is not established in the EU and there is no manufacturer, importer, or distributor established in the EU – the platform concerned should in that case be held liable for products which do not comply with the relevant legislation. • Reporting obligations, as well as regulatory oversight should be proportionate.
