Changes to Annex IX Part B The considerable changes to Annex IX Part B in the proposal would lead to a far greater supply availability of feedstocks from this category. That in itself is a welcome result as it opens up much greater decarbonisation potential from renewable fuels based on genuine wastes. However, the changes would be utterly irrelevant, and would not deliver any benefits, if the cap on their use stays in place. The existing restriction on the use of Part B feedstocks is now out of date, unnecessary and only works as a tool for restricting decarbonisation and limiting the displacement of fossil fuels. Any arguments that a cap is a sensible method to be employed for uncovering or stopping fraud is now completely redundant when considering the introduction of the Union database in the first quarter of 2023. Without an impact assessment, the review is unable to quantify what levels of Part B feedstock are available but many in the industry believe the volumes are more than 100 times the amount that the cap would otherwise restrict the EU to. In the face of the looming climate change disaster, the cap flies in the face of common sense and indeed of the global decarbonisation leadership that we in the EU desire. While removal of the cap is the most obvious answer (aligned with introduction of the Union database and other improvements to the certification and verification schemes), an allowance for all Member States to go above the cap would also permit the increased use of these new Part B feedstocks accordingly, as long as the process to permit that is clear, simple and transparent. There should be no limit to Member States for the use of these truly sustainable feedstocks. Annex IX Part A feedstocks There are widespread and serious concerns about how the feedstocks damaged crops and cover crops can be assessed effectively to ensure they are genuine and truly sustainable with no direct effect on land use. Guidance to the industry on how the Commission intends to ensure verification of these feedstocks, either through the voluntary schemes or other means, is crucial. We support the various submissions from EU biofuels associations in their calls to ensure transparency and best possible verification on this issue.
