Response to Digital package – digital omnibus

Anitec-Assinform is Italy's leading ICT industry association. We represent companies across the entire digital value chain, many of which face increasing regulatory complexity that risks undermining innovation and competitiveness in the EU. We support the Commission's simplification agenda and have prepared feedback focused on practical solutions that uphold the EU's trustworthiness and security objectives while fostering a thriving digital economy. Our response addresses four key regulatory areas. On Artificial Intelligence, we propose greater flexibility for AI systems covered by existing sectoral frameworks, realistic implementation timelines aligned with standards availability, and measures to make sandboxes more attractive while raising GPAI systemic risk thresholds. For Cybersecurity, we call for harmonized incident reporting requirements across NIS2, CRA, and DORA, an effective one-stop shop platform, coordinated vulnerability disclosure, and prioritization of harmonized standards over common specifications. Regarding the Data Economy, we recommend deferring mandatory interoperability standards until market necessity is demonstrated and replacing rigid structural separation requirements for data intermediaries with operational controls. On Data Privacy, we take a bold stance: we propose repealing the ePrivacy Directive entirely, as the GDPR already provides a robust legal framework. The principle of confidentiality of communications should be incorporated directly into the GDPR itself, creating a single coherent legal framework. Alternatively, if the Directive is maintained, we recommend targeted updates with clear exemptions for low-risk processing activities. Response to EU Start-up and Scale-up Strategy

Anitec-Assinform is the business association representing the Information and Communication Technology industry in Italy. As such, we present the unique perspective of the Italian digital ecosystem, comprised of major global players, national champions, fast-growing SMEs, startups and scaleups. We believe the Potential of the EU Single market untapped due to persistent barriers, regulatory fragmentation, and the increasing innovation gap between the EU and global partners. This unreleased potential affects the whole digital value chain as startups and scaleups operate within a broader ecosystem that affects their ability to grow, compete and generate industrial innovation. The attached document outlines insights and recommendations for the upcoming strategy. We provide extremely recent data on the ICT startups and innovative SMEs and we outline our position on two key issues we believe should be crucial in the forthcoming strategy: 1) Completing an Innovation-Friendly Single EU Market: address the regulatory complexity and cross-border fragmentation that currently hinder digital companies from scaling across Europe. This includes harmonization of the Digital Single Market's regulatory framework and establishment of a "28th regime" to provide a unified legal status for innovative European companies, and complementary policy initiatives to foster corporate-startup collaboration, support global expansion, and strengthen innovation infrastructure. 2) Strengthening Growth Enablers Talent, Data, Computing: ensure that innovative companies have access to the fundamental resources needed to scale - particularly to address the ICT skills mismatch and secure adequate access to data and computing infrastructure.

The Italian digital sector is committed to promoting the EU Single Market, to foster innovation and competitiveness at a European level. The attached document outlines three key recommendations for the upcoming strategy: Remove obstacles to the completion of the Single Market - Identifying areas where the EU can promote harmonisation, expanding the Single Market. Uphold the one-stop-shop principle - Addressing governance challenges within the existing EU regulatory framework. Response to Rules specifying the obligations laid down in Articles 21(5) and 23(11) of the NIS 2 Directive

Please find attached Anitec-Assinform's comments to the draft implementing act regarding cybersecurity risk management & reporting obligations for digital infrastructure, providers and ICT service managers under the NIS 2 directive. The association welcomes the opportunity to contribute to this draft. The comments find that the Act could be improved by reducing the prescriptive provisions, in favour of an approach prioritising accountability of NIS subjects, reliance on existing cybersecurity frameworks and standards, and pragmatism regarding incident reporting requirements.
