L’Autorità è competente nel settore dei trasporti e dell’accesso alle relative infrastrutture e ai servizi accessori e garantisce, secondo metodologie che incentivino la concorrenza, l'efficienza produttiva delle gestioni e il contenimento dei costi per gli utenti, le imprese e i consumatori, condizioni di accesso eque e non discriminatorie alle infrastrutture ferroviarie, portuali, aeroportuali e autostradali, nonché la mobilità dei passeggeri e delle merci in ambito nazionale, locale e urbano, anche collegata a stazioni, aeroporti e porti.

Response to Common form for reimbursement and compensation requests of rail passengers

- The draft implementing act establishing a common form for reimbursement requests pursuant to Regulation (EU) 2021/782 refers, under Article 1, to reimbursement and compensation as referred to in Articles 18(6) and 19(5). Further, Section 1 of the form 1. Reason(s) of your request indicates three possible reasons of the request: delay, cancellation, missed connection. Nevertheless, it is not clear whether the reimbursement or compensation referred to in article 12 (4) of the Regulation (4. Where a ticket or tickets are purchased in a single commercial transaction and the ticket vendor or tour operator has combined the tickets on its own initiative, the ticket vendor or tour operator that sold the ticket or tickets shall be liable to reimburse the total amount paid for that transaction for the ticket or tickets and, moreover, to pay compensation equivalent to 75 % of that amount in the event that the passenger misses one or more connections) may be requested through the common form as well. - With reference to recital (6) of the draft implementing act, it should be clarified that, if railway undertakings provide their web form and their downloadable online form, including at least the same data as in the EC common form for reimbursement/compensation requests, in addition to the data for requesting any further cases of compensation provided for under national regulations (e.g., as in the case of Italy, with regard to the definition of the minimum rights and entitlements, including compensation, that may be claimed by users from transport infrastructure managers and service providers) or under individual general transport conditions (e.g. compensation for delays of less than 60 minutes), they should be exempted from the obligation to make the common form available on their website. - With reference to article 3 of the draft implementing act and, in particular, to the possibility of transmitting the form both as a physical document and electronically, it should be clarified how the common form is to be sent in the event that the e-mail is not included in the channels that can be used for transmission of reimbursement/compensation requests provided for by the undertaking. A railway undertaking, in fact, may have set up an online interface for entering the request, without providing for the possibility of sending the completed form to an e-mail address; and this could be functional to a more rational management of the requests (e.g., the information contained in a form filled in by hand and sent by e-mail is not always clearly readable), without prejudice to the need to provide a channel that can be used by non-Internet users, too (e.g. mail, over-the-counter delivery). - In section 3. Nature of your request of the common form, further information could be added in a footnote referring to the timeframe for the recognition of the reimbursement referred to in Article 18 (1) (a) and (3) (30 days) and for the compensation referred to in Article 19 (within one month), as well as regarding the minimum threshold of EUR 4 under which the compensation referred to in Article 19 will not be paid. - In section "4.4. Preferred form of payment for reimbursement/compensation" the credit/debit card option should be added.
