Empfehlung des BAVC Wahrung der Subsidiarität: Die Gestaltung der Altersvorsorge sollte weiterhin maßgeblich in nationaler Verantwortung bleiben. EU-Regelungen dürfen bestenfalls einen groben Zielrahmen beschreiben und müssen ausreichend Raum für nationale Besonderheiten und tarifliche Lösungen lassen. Verhältnismäßigkeit und Flexibilität: Neue Vorgaben sollten verhältnismäßig ausgestaltet und auf die tatsächlichen Risiken zugeschnitten sein. Die Vielfalt der Versorgungslandschaft und der Durchführungswege in Deutschland ist eine Stärke, ermöglicht passgenaue Lösungen und muss erhalten bleiben. Abbau von Bürokratie: Berichtspflichten und Governance-Anforderungen sollten auf das notwendige Maß begrenzt werden, um die bAV nicht zu überfrachten und die Teilnahmebereitschaft der Unternehmen zu sichern. Betriebliche und tarifliche Versorgungssysteme und -Einrichtungen dürfen nicht mit im wettbewerblichen Markt an Privatpersonen angebotene Finanzmarktprodukte gleichgesetzt werden. Stärkung der bAV statt Konkurrenz durch PEPP: Die betriebliche Altersversorgung sollte dort wo sie nachweislich gut funktioniert als zentrales Element der Altersvorsorge weiter gestärkt werden. PEPP kann in Ländern ohne entsprechende Produktangebote eine sinnvolle Ergänzung sein, darf aber funktionierende Modelle nicht in Frage stellen oder beschädigen. Die Einführung eines Auto-Enrolment sollte flexibel und sozialpartnerschaftlich durch Akteure vor Ort entschieden und ggf. ausgestaltet werden, um bewährte Strukturen nicht zu gefährden. Eine verpflichtende Teilnahme ohne ausreichende Qualitätssicherung birgt zudem die Gefahr von ineffizienten Pflichtsystemen ohne echten Mehrwert. Die Kapitalanlage muss global ausgerichtet werden können: Um die Altersvorsorge attraktiv und nachhaltig zu gestalten, sollten keine politischen Beschränkungen für die Diversifikation der Anlagen festgelegt werden. Eine evtl. Fokussierung auf den europäischen Kapitalmarkt darf nicht zu Lasten der Rendite und damit der Versorgungssicherheit gehen. Unsere detaillierte Stellungnahme senden wir in der Anlage.
