Response to Chemicals strategy for sustainability

CGIL response to the Roadmap consultation on the Chemicals Strategy for Sustainability (June 2020) CGIL is convinced that the future Chemicals Strategy within the European Green Deal presents a unique opportunity to radically scale up and speed up actions to protect citizens, workers, and the environment from chemical hazards and risks while setting Europe and its industry on the road to a sustainable transition. Chemicals can bring benefits to our society, but many also contribute to the rise in both severe health problems across the EU and the pollution of the environment, leading to high societal and economic costs. For example, carcinogens used at work cause more than 100 000 cancer deaths per year in the EU. The cost of these work-related cancers is estimated to be between €270 and €610 billion each year – or between 1.8% and 4.1% of the EU’s annual gross domestic product1. This strategy should therefore help Europe shift towards a safe use of chemicals and a toxic-free environment. It should also support other agreed priorities at EU level like the fight against cancer, the sustainability of the food system and the transition to a climate-neutral and circular economy. CGIL is of the opinion that the future Chemicals Strategy must deliver a concrete action plan with clear timelines to strengthen the current EU regulatory framework on chemicals (see joint BEUC, EEB and ETUC policy recommendations) in order to: • effectively reduce our overall exposure to chemicals of concern. This will require swift identification and phasing out substances of very high concern (SVHC) across all EU chemicals legislations and adopting Binding Occupational Exposure Limit Values (BOELs) for 25 extra priority carcinogens under the Carcinogens and Mutagens Directive (CMD) by 2024; as well as accounting for and regulating low-dose effects and the cumulative impact of chemicals from multiple sources (mixture effects) well before 2030. • guarantee coherence and integration across different EU policies (occupational, market rules, environment, etc.) The scope of the Carcinogens and Mutagen Directive must be extended to cover substances toxic for reproduction and hazardous medicinal products no later than 2024. Stricter rules are also needed to prevent toxic recycling and eliminate SVHC from the circular economy. • address chemical risks posed by endocrine disruptors and nanomaterials. A new hazard class should be introduced in the CLP regulation and the GHS to treat them similarly to CMRs and ensure that all relevant legislative frameworks are adapted no later than 2030 to protect the health of current and future generations. REACH should be improved to better cover risks posed by nanomaterials. • ensure full disclosure of chemicals present in products and workplaces. By 2030 the EU should establish a harmonised mandatory and public information system on chemicals in products, materials, and waste. • boost the use of safer alternative chemicals, products, and processes by establishing economic incentives to support substitution, clean production, frontrunner companies, eco-labelling schemes, and green public procurement. • better protect our vulnerable populations (i.e. infants, pregnant women) as well as key ecosystems and species. This should be done by 2024 through updating existing laws to better address chemicals of concern (e.g. on cosmetics, food packaging, water), and through new laws, (e.g. on child-care products or textiles). • Increase access to information and participation for workers, consumers and health and environmental organisations in decision-making processes to ensure that the regulatory system is responsive to citizens’ concerns. Moreover, the EU regulatory framework on chemicals must be based on the precautionary principle to ensure early action on early warnings.
