Response to State aid rules for public service broadcasting - Evaluation

Confindustria Radio Televisioni (CRTV) welcomes the opportunity to contribute to the request for evidence concerning the assessment of the State aid rules applicable to public service broadcasting. In this regard, CRTV reaffirms that the regulatory framework established by the Commission's 2009 Com-munication on Broadcasting, regarding the application of State Aid Rules to Public Service Broadcasting, remains fundamentally fit for purpose and does not require further amendments or addenda. The current legal framework successfully balances: financial transparency and fair treatment; effective public accountability; conformity with the latest European regulations and especially with the EMFA; broad discretion granted to Member States to choose the framing, funding, and remit of public service broadcasting. The regulatory framework under discussion has thus enabled public service broadcasters to fulfil their remit while adapting to technological change. Furthermore, this has been achieved without compromising the competitive dynamics between private operators and public service broadcasters, thereby ensuring the in-tegrity of the internal market. Looking at current market dynamics, the main risk to public service broadcasting in Europe does not lie in overfunding or excessive compensation. Rather, it lies in having insufficient resources to: support reliable and universally accessible audiovisual services; promote innovation in technologies, including the DTT platform, which is the most widespread and ac-cessible to all users; strengthen a distinctive European audiovisual model equipped to compete in a globalised, platform-dominated market. A reduction in funding for public service broadcasting would inevitably compromise the quality and inno-vation of content, thereby eroding Europe's ability to preserve media pluralism, cultural diversity, and dem-ocratic integrity. CRTV therefore strongly supports maintaining the current regulatory architecture and its fundamental prin-ciples, as set out in the 2009 Broadcasting Communication. Any evaluation of the State aid framework must fully acknowledge the strategic importance of public services in enabling European broadcasting companies to compete in a profoundly changed and constantly evolving market environment. This is in order to ensure the production of national and European identitarian content, alongside employment and professional and verified information.

Response to Update of EU rules on audiovisual media services

Con il presente contributo Confindustria Radiotelevisioni intende fornire alcune riflessioni relative alle prospettive di revisione del complesso di norme di cui alla Direttiva AVMSD, nellottica di dare un contributo allevoluzione della disciplina in senso pro-concorrenziale. LAssociazione condivide lapproccio n° 2 denominato Intervento normativo mirato indicato dalla Commissione nella sezione B del documento in consultazione. Tale orientamento pare idoneo a far evolvere il quadro normativo dellUE rispetto alla profonda evoluzione tecnologica, intervenuta dopo lultima revisione della direttiva nel 2018, che ha investito le strutture di produzione e distribuzione del mercato audiovisivo europeo, oltre a colpire i fatturati delle aziende che tradizionalmente operano nel settore. CRTV sollecita in ogni sede interventi sui temi più critici emersi negli ultimi anni: prominence (rilievo dei servizi di interesse generale), rilevazione degli ascolti e introiti da pubblicità, tutela degli spettatori, in particolare minori, e definizione di produttore indipendente. Levoluzione predetta dovrà provvedere al fine di disciplinare, sotto il profilo giuridico e di politica economica, questi aspetti critici, mantenendo i risultanti che la direttiva vigente ha prodotto in termini di pluralismo, tutela e promozione delle opere europee. Sembra prioritario, in questo contesto, chiarire che le regole valide per il settore audiovisivo si applicano a tutti gli operatori, anche agli over the top, le piattaforme digitali e le piattaforme di condivisione video. Solo così si potranno evitare le attuali distorsioni del gioco della concorrenza.

CRTV emphasizes the need to preserve the balance of the audiovisual ecosystem, particularly in countries like Italy where free-to-air TV ensures universal access to local and EU contents and supports cultural and social cohesion. Free terrestrial television remains the primary channel for distributing local, cultural, and public interest content, with wide coverage, technological neutrality, and protection for vulnerable users. Any reform that undermines its economic sustainability or distribution capacity-indirectly supporting OTTsrisks harming media pluralism, weakening national information sovereignty, and damaging broadcasters' business models that sustain quality contents and employments. CRTV urges policymakers to: Preserve UHF Band 470694 MHz for terrestrial broadcasting at least until 2040 with longer license duration (at least the double of existing licence term) or easier renewal. This spectrum is crucial for ensuring universal, free access to general interest content, especially given the challenges broadcasters have faced due to regulatory uncertainty Recognize TV as a general interest service, not subject to purely commercial logic or digital innovation strategies that risk excluding less connected populations Avoid measures that lead to a forced transition to online platforms, which centralize access, rely on non-EU infrastructure, and reduce user control Ensure fair competition between traditional operators and OTTs by enforcing equivalent rules for all players TV is not merely a transmission medium, but a pillar of democracy, inclusion, and social cohesion, values protected also by EU. CRTV warns against convergence-driven policies that ignore the unique public value of broadcasting by treating all services as equal, regardless of their public mission. Sustainability Terrestrial digital broadcasting is the most efficient, resilient, and environmentally sustainable way to provide universal, free linear TV. It offers minimal CO emissions and is ten times more energy-efficient than internet-based distribution. It remains the only viable platform for reaching certain population segments and it is the only means not profiling by design. Simplification CRTV supports regulatory simplification if it eases the burden on EU operators and addresses the regulatory imbalance that currently favours OTTs. Loopholes in the e-Commerce Directive have allowed global platforms to dominate, impeding the growth of EU players. Level Playing Field CRTV strongly opposes new obligations on AVMS providers to fund Telco universal service duties or any measure directly or indirectly affecting the heavily regulated audiovisual sector. CRTV also rejects additional charges for online content distribution, already covered by existing contracts. CRTV stresses the importance of maintaining net neutrality under the Open Internet Regulation, which has supported cooperation and fair market dynamics. There is no market failure justifying further intervention. Radio Spectrum Policy Spectrum use must reflect national specificities. The 470694 MHz band remains strategically vital in many MS, not only for broadcasting but also for PMSE. EU harmonization must respect each MSs right to manage spectrum for public interest, cultural, security, and defence needs. Auctions must remain at a national level. The EECC acknowledges the need to separate network regulation from content regulation and supports media pluralism, granting broadcasters a special status. CRTV warns against approaches that blur the line between infrastructure and content, threatening this pluralism. Conclusion CRTV calls for a flexible political approach that respects national differences, industrial models, and socio-cultural priorities. Clear rules and the explicit recognition of broadcastings public value are essential for a pluralistic, sustainable, and accessible EU media landscape where local content and public interest are not sacrificed to unchecked innovation.
