Response to Modernising the EU’s batteries legislation

Cummins supports the effort to modernize the existing Batteries Directive through tough, clear and enforceable regulation. It is Cummins’ opinion that such regulation is not only helpful to human health and the environment, but also enables fair trade and a level playing field in terms of market access. We are currently in a transitional period where it is unclear what technologies may power the future of on and off highway equipment. Hydrogen, electrified battery power and fossil fuels will all play a part in how equipment is powered over the next two decades. Efficiency, cost, innovation and supply chain capability will all be factors in the adoption of new technologies. However, certain provisions of the proposed regulation are either unclear, present disproportionate requirements on battery manufacturers/their supply chain or may otherwise limit innovation. Any of which may unintentionally slow down the overall migration of industry to cleaner, electrified power. For this reason, we welcome the opportunity to provide feedback on the European Commission’s Proposal for a Regulation on batteries and waste batteries. As such, we offer our experts as a resource to collaborate with the European Commission on a viable path forward to accelerate electrification and put forward our recommendations on three aspects of the proposal: Where More Clarity is Needed: • We recommend the Proposal further developed the battery concept to allow for a definition of the denominator for other recycling/recovery requirements • An improved definition of end of life and second use would enable re-use and better define responsibilities of those placing products on the market for the very first time • We also recommend the proposal further clarified the procedures for carbon footprint definition and exclusion of use phase from this requirement Disproportionate Requirements: • While we confirm our objectives to support the Commission’s objective to increase the sustainability of batteries placed on the EU market, we share the views that the proposed battery management system represents disproportionate requirements for OEM’s to disclose potentially trade secret information and an administrative burden to track the device to its second life • Besides, it highlights the potential for double/overlapping regulation between REACH, ELV, WEEE and RoHS • We recommend a revision of the requirements for OECD framework at battery OEM level, where there is little leverage or visibility to smelters/mines • Article 65 on Battery Passport information seems to place an undue and disproportionate administrative burden on OEM’s, and could, thus, be revised to find better balance in this obligation Impediments to Innovation: • Article 8 on recycled content requirements should be revised to better address battery design, recycler capability and industry capacity to economically recover/refine recycled material • We recommend Article 7 on carbon footprint of electric vehicle batteries and rechargeable industrial batteries is revised to ensure that the requirements do not act as impediments to innovation, as they could be calculated and communicated without a consistent process and the necessary transparency throughout the supply chain. • The requirement for manufacturers to undergo a third-party certification of conformity assessments from Annex VIII is disproportionate and inconsistent with other environmental directives which allow for self-certification Cummins appreciates the opportunity to provide this and further input in the attached document as part of this stakeholder consultation. We welcome the results of this effort and stand ready to engage in further discussion.

Response to EU Action Plan Towards a Zero Pollution Ambition for air, water and soil

As a global business operating in many European countries, Cummins welcomes the European Commission’s goal to secure clean air, water and soil, healthy ecosystems and a healthy living environment for Europeans. Cummins has been working on an ambitious environmental sustainability strategy which is aligned with these aspirations. Our 2050 goals include: • Net positive impact in every community where we operate • Near zero local environmental footprint • Customer success powered by carbon neutral technologies that address air quality • Carbon neutrality and near zero pollution in Cummins' facilities and operations • Nothing wasted • Design out waste in products and processes • Use materials again for next life • Reuse water and return clean to the community And by 2030 we will: • Reduce absolute greenhouse gas (GHG) emissions from facilities and operations by 50%. • Reduce scope 3 absolute lifetime GHG emissions from newly sold products by 25%. • Partner with customers to reduce scope 3 GHG emissions from products in the field by 55 million metric tons. • Reduce volatile organic compounds emissions from paint and coating operations by 50%. • Create a circular lifecycle plan for every part to use less, use better, use again. • Generate 25% less waste in facilities and operations as percent of revenue. • Reuse or responsibly recycle 100% of packaging plastics and eliminate single-use plastics in dining facilities, employee amenities and events. • Reduce absolute water consumption in facilities and operations by 30%. Response to Administrative provisions for emissions limits for Non-Road Mobile Machinery engines

This amendment contains important corrections and clarifications to support stage V certifications. These are already underway in the industry. It passage to the OJEU should be expedited to achieved the earliest possible publication date.
