Response to List of aircraft types and models exempted from meeting the requirements on data link services

Thank you to give us the opportunity to comment these documents. The purpose of this feedback from Dassault Aviation French aircraft manufacturer, concerns the two drafts EC decisions on aircraft types/models to be DLS exempted. Dassault Aviation proposes a modification to these drafts EC decisions (Temporary Exemption). This proposal is in line with what was said during the last RMT.0524 Working Group in Cologne mid of June 2019. Firstly, Dassault Aviation respectfully request to add to the Annex II the following Falcon aircraft: Falcon 7X, Falcon 8X and Falcon 6X as there is no reason not to include them. Secondly, We ask to postpone the Temporary Exemption date to February 5, 2025. The goal of these modifications is to give enough time to find a valid technical solution, to develop, certify and plan it, so that these Falcon aircraft may fully take advantage of the data link system. As you probably know, this present datalink on-board installation on Falcon aircraft is completely certified by the European Aviation Safety Agency while the use of the equipment by pilots is not accepted by some ANSP (White-list vs Black-list issues). Effectively, these additional Falcon aircraft are more rent or new but the onboard avionics including Datalink system ATN B1, is the same as the present ones so with the same concerns as some other Falcon aircraft already exempted such as Falcon 2000EX EASy , Falcon 900EX EASy. In the two EC drafts decisions the modifications proposed by Dassault Aviation are the following: "Dassault Aviation (France) PART-2019-293409V2 - Annex II, in addition to aircraft Falcon 2000 all - Dassault F2TH and Falcon 900 all - Dassault F900, please add the following: - Falcon 7X Dassault F7X, - Falcon 8X Dassault F8X - Falcon 6X Dassault F6X PART-2019-293408V2, in Article 2 Dassault Aviation propose that Falcon aircraft listed here below shall be exempted from the requirements of Article3(2) of Regulation (EC) N° 259/2009 until 5 February 2025." Note: Dassault Aviation is not concerned by Annex I because the new amendment (EU) 2019/1170 of 8 July 2019 Article 1 (d) is covering Falcon aircraft already in service. Best regards
