Response to European Critical Raw Materials Act

Eramet, a European mining and metallurgical group, is a key player in the extraction and refining of base metals necessary for the overall growth of our economy (manganese, mineral sands) and those critical for the transition to a climate neutral economy (nickel, lithium, cobalt). As a European company and currently chairman of the European Raw Materials Alliance (ERMA) Battery task force, we are working towards becoming a major contributor to fulfil the European demand in base metals by 2030. We are developing activities with high growth potential, from our own mines of Lithium in Argentina and Nickel/Cobalt in Indonesia and New Caledonia to metallurgical transformation activities in Europe, combined with batteries recycling development projects, with the aim to become a one-stop shopping place for raw materials supplying the European electrical vehicles (EV) value chain. The Group intends to become a partner of choice for the European battery industry, through responsible primary metals extraction and batteries recycling activities. The Group supports the transition to a carbon neutral economy by developing activities strategic for Europe to sustain its leadership and autonomy in this transition. Eramet welcomes the European Commission (EC) proposition for a Critical Raw Materials (CRM) Act. Covid and Ukrainian crisis have highlighted the necessity for the European Union (EU) to secure its supply of CRM, particularly nickel, cobalt, and lithium because they are necessary to become climate neutral by 2050.

Eramet urges EU to include mining in sustainable taxonomy

Message — Eramet requests that the extraction and transformation of critical materials become eligible under the taxonomy. They argue these are essential enabling activities for the transition to electric vehicles.12
Why — This would prevent a lack of financing from jeopardizing the group's mining developments.3
Impact — Non-virtuous mining operations would lose investment to more environmentally responsible European competitors.4

Response to European Critical Raw Materials Act

Eramet, a European mining and metallurgical group, is a key player in the extraction and refining of base metals necessary for the overall growth of our economy (manganese, mineral sands) and those critical for the transition to a climate neutral economy (nickel, lithium, cobalt). We are working towards becoming a major contributor to fulfil the European demand in base metals by 2030. We are developing activities with high growth potential, from our own mines of Lithium in Argentina and Nickel/Cobalt in Indonesia and New Caledonia to metallurgical transformation activities in Europe, combined with batteries recycling development projects, with the aim to become a one-stop shopping place for raw materials supplying the European electrical vehicles (EV) value chain. Eramet welcomes the European Commission (EC) initiative to propose a Critical Raw Materials Act. As the demand for those base metals in the coming years is going to explode and the risk of EU dependencies on external resources is real, this new regulation must support the urgent need to secure and develop our supply in critical raw materials. Eramet will take actively part in the upcoming discussions, as it will contribute to assure a green and clean future for the EU. Eramet provides in the attached document very pragmatic recommendations about the EC proposal.

Response to Commission Delegated Regulation on taxonomy-alignment of undertakings reporting non-financial information

Eramet déplore que les activités minières n’aient pas été considérées pour l’acte délégué « climat ». Or la transition énergétique vers une économie bas carbone va nécessiter la production de très grandes quantités de certains métaux, notamment pour les batteries. Pour ne pas les pénaliser, nous proposons qu’une catégorie « d’activité non couverte » soit créée afin de bien établir la différence avec les activités non éligibles à la taxonomie. Nous alertons sur le danger qu’une activité non couverte par les évaluations soit considérée comme non -éligible.

Response to Revision of EU legislation on hazard classification, labelling and packaging of chemicals

Eramet souhaite souligner les progrès réalisés ces dix dernières années dans la classification, l’étiquetage et l’emballage des substances chimiques. Nous estimons donc qu’il est trop tôt pour proposer une révision du règlement CLP et nous mettons en garde contre le risque d’une complexification des procédures.

Response to Revision of EU legislation on registration, evaluation, authorisation and restriction of chemicals

Nous estimons que la révision de REACH doit aller de pair avec une modification des concepts avec lesquels les substances chimiques sont appréciées. Nous déplorons, en effet qu’à l’heure actuelle, les évaluations se basent principalement sur le « danger » (« hazard ») que les substances pourraient représenter et non pas sur le « risque » (« risk »). La notion de « risk » doit absolument revenir au cœur des évaluations et celle de « hazard » doit être considérée différemment qu’actuellement, surtout concernant les restrictions sur les substances. Il est nécessaire de trouver un équilibre entre ces deux grilles de lecture. Il n’existe pas à l’heure actuelle de contrainte règlementaire pour cela, ce que nous regrettons. Ajuster cette balance contribuera à la mise en place d’une économie circulaire européenne, voulue par la Commission ainsi qu’à la sauvegarde des emplois et des savoir -faire. Si l’Europe estime que le danger inhérent à la production de certaines industries est trop grand, cela peut être perçu comme un signe pour les entreprises, à se délocaliser et pour les citoyens, à acheter des produits fabriqués à l’étranger. L'Union européenne induit donc une délocalisation de la production et des dangers par une distorsion de la concurrence en créant une zone défavorable à l’industrie. Il est important pour préserver la santé de tous et l’emploi d’exiger un management du risque efficace et efficient et qui soit économiquement applicable en Europe. L’exemple du futur traitement du lithium est pertinent pour expliquer cette position. Le lithium est un métal faiblement toxique avec quasiment aucune classification CLP. Alors que son usage devient stratégique pour l’Europe, une demande de classement en CMR avéré pour l’humain est en cours, sur base d’anciennes études qui concernent son usage par voie orale comme médicament. Nous nous posons la question de la pertinence d'un tel classement qui induirait une stigmatisation d'un métal stratégique pour l’avenir sur la base d’un autre usage (très particulier). Il en est de même pour le cobalt, où un procédé de niche, utilisant des poudres de cobalt ultra-fines et cancérogène en grande partie de par leur forme et leur taille va induire la classification CMR des inox qui sont par ailleurs reconnus comme un matériel recyclable, hygiénique et sain. La révision de REACH doit donc permettre aux parties prenantes de ce règlement d’être assurées que les jugements sur l’évaluation des substances chimiques seront mieux pondérés à l’avenir en fonction des procédés et des formes utilisés.
