Response to European Critical Raw Materials Act

Airbus welcomes the Critical Raw Materials Act package proposed by the European Commission, aimed at strengthening the EU CRMs security of supply from within and with the support of like-minded partners. Airbus and its suppliers depend almost exclusively on raw material imports and any EU attempt to build more resilience in CRM supply is more than welcome. Airbus has been adversely affected by strategic dependencies to certain exposed regions in the aftermath of the conflict in Ukraine. The situation is still not fully stabilized and some other vulnerabilities could arise in other parts of the world. The Commissions proposal is ambitious, but it is only a partial response to the CRM needs of Airbus and the broader Aerospace & Defence industry. Airbus needs your support to ensure that the Aerospace & Defence needs and specificities are fully considered and protected throughout the Critical Raw Materials Act. Response to Net Zero Industry Act

Airbus welcomed the publication early February 2023 of the European Commission Communication for a "Green Deal Industrial Plan for the Net-Zero Age", as an indication of the EU's growing awareness of the competitiveness issues facing European industry and the need to take action to support the rapid transition to carbon neutrality. Airbus has repeatedly called for the EU to develop an ambitious package to accelerate the energy and industrial transition, and to ensure that new technologies and clean energy necessary to fuel the transition in commercial aviation are made available in Europe. The Green Deal Industrial Plan is a unique opportunity to quickly boost the production of clean energy necessary to meet the objectives of the Green Deal and to answer to concerns raised by the unlevelled playing field created by the US IRA. From that perspective, Airbus welcomes the Net Zero Industry Act as an appropriate 1st step going in the right direction to address administrative hurdles that are slowing down the emergence of net-zero energy ecosystems necessary for the decarbonisation of aviation, i.e. hydrogen, carbon capture and Sustainable Aviation Fuels (SAF). However, Airbus is concerned not to see Sustainable Aviation Fuels and Carbon Capture Usage included in the list of the Strategic Net Zero technologies, nor to see Liquid Hydrogen technologies included at all amongst the Net Zero technologies. This stands in stark contradiction with rightly defined EU priorities, implemented through regulation (Refuel EU) and Alliances (notably the Renewable and Low-Carbon Fuels Value Chain Industrial Alliance (RLCF) and Alliance for Zero-Emission Aviation (AZEA)). We therefore call for the identification of both Sustainable Alternative Fuels technologies (including Sustainable Aviation Fuels) as well as Carbon Capture Usage technologies as Strategic Net Zero Technologies. We also call for Liquid Hydrogen Technologies to be recognized as Net Zero Technologies. At last, we call for the definition of Carbon Capture to be as large as possible, in order to include all related technologies and pathways. The risk otherwise is to create a new energy dependency of Europe towards other regions of the world for an industry which is both central to the trade balance of Europe and hard to abate. It is the leadership and independence of Europe in aviation that are at stake. Ensuring an efficient monitoring and governance will be a key success factor, in particular facing non-EU political initiatives and competition. We welcome the creation of the Net Zero Europe Platform, and would call for stronger links to be established between the latter and all EU Industrial Alliances, including AZEA and RLCF. Lastly, the NZIA should not limit itself at a short term time horizon - incentivising investment will require mid and long term visibility. If setting objectives of production for 2030 is a very welcome approach, the text needs to be able to remain applicable beyond that date and regular updates and adaptations should be foreseen. Response to Communication on revamping the SET Plan

Airbus is committed to support the ultimate objective to reach a net-zero carbon emissions aviation ecosystem in Europe by 2050, as well as strongly contributing to the EU’s 2030 ambition. Accordingly, Airbus supports the European Strategic Energy Technology Plan (SET Plan) to accelerate and boost the transition towards a climate-neutral energy system by developing low-carbon technologies. In order to achieve such a goal, we understand the need to renew policy objectives and targets for the development of innovative clean energy solutions and preparing for their deployment as well as pooling national and European research and innovation resources. The Strategic Energy Technology Plan is also helping to curb the recent increase in energy prices by reducing the EU’s dependence on fossil fuels by increasing energy efficiency and the share of renewable energy sources. To this end, the 14 SET Plan Implementation Working Groups (IWGs) have established ambitious research and innovation targets to be reached in the next decade(s) in energy efficiency and low-carbon energy technologies. In light of the launch of the Fit for 55 package, and the need to enhance EU competitiveness in clean energy technologies, the SET Plan is working to extend its ambition in terms of the objectives and targets to be achieved, expanding its scope to include emerging technologies which are fully supported by Airbus. We particularly want to address Airbus willingness to contribute to the following Implementation Working Groups: - Renewable fuels and Bioenergy for sustainable transport (including SAF and Hydrogen): this will aim at improving the production performance of advanced biofuels, synthetic fuels and other renewable liquid and gaseous fuels particularly addressing GHG performance and cost. Various projects have been supported by the EU for scaling-up renewable energy (e.g. Blaze, Lignocellulosic Ethanol, Synkero…), yet it is worth noting that Airbus is currently part of other alliances which can contribute and support the objectives of this plan and therefore we can build bridges amongst them. - Carbon Capture and Storage - Carbon Capture and utilisation - developing commercial-scale CCS projects from industrial CO2 sources, as well as in the power sector; - developing European cross-border CO2 infrastructure and monitoring the progress of European CO2 projects of common interest; - promoting pilot projects on promising new capture technologies such as Direct Air Carbon Capture and usage and storage capacities; and - unlocking European CO2 storage capacity. - Energy Efficiency in Buildings: it will support the selection of the most advanced heating and cooling technologies as well as new materials and technologies for buildings. - Energy Efficiency in Industry: it will help to integrate renewable energy into the energy system including hydrogen-based technologies and infrastructure. It would also support enhancing circularity principles (e.g. the reuse of waste heat or the development of biofuels) related to industrial processes. - Batteries: Battery value chain might have a key role in the e-mobility as well as in the transport sector by providing relevant storage capacity. To ensure consistency with existing and upcoming initiatives and ensure participation of companies like Airbus, we would like to recommend to take into consideration the following: - Include aviation in the roadmaps under preparation by Research and Technology Organisations for the development of Technology infrastructures (including notably the following technology: hydrogen electrolysis, liquefaction, pipings, shipping, refuelling and hydrogen Ground Support Equipments at Airport); - Increase investment and cooperation with the National Energy and Climate Plans related to Energy Research and Innovation domain; - Support the implementation of instruments which promote the upskilling and reskilling of the renewable energies ecosystem including Hydrogen. As a complement to Clean Aviation and Clean Hydrogen Joint Undertakings, as well as industrial alliances1, we would like to increase our involvement and demonstrate our commitment to this Strategic Energy Technology Plan revision, and we are studying the involvement of aviation stakeholders in the following energy-related European Technology and Innovation platforms (ETIPs): - Zero Emission Fossil Fuel Power (ZEP) which is the technical adviser to the EU Commission on the deployment of CCS and CCU - ETIP Bioenergies which contribute to the development of cost-competitive, innovative world-class bioenergy and biofuels value chains, to the creation and strengthening of a healthy European bioenergy industry and to accelerate 1 Alliance for Zero-Emissions Aviation, Renewable and Low Carbon Value Chain Alliance, Clean Hydrogen Alliance the sustainable deployment of bioenergy in the European Union through a process of guidance, prioritisation and promotion of research, technology development and demonstration. In conclusion, Airbus welcomes the Commission’s initiative to revamp the European Strategic Energy Technology Plan and we would like to take the opportunity for aviation to be taken into consideration through the above-mentioned SET implementation working groups.

Response to Alignment EU rules on capital requirements to international standards (prudential requirements and market discipline)

Airbus welcomes the opportunity to comment on the proposed regulation, and would like to provide feedback on the considered strengthening of the applicable terms to trade finance instruments, particularly to technical guarantees. Airbus remains solidly rooted in the European banking system, and has therefore a vested interest in avoiding a potential loss of competitiveness of European banks versus the non-European ones in case the implementation of Basel IV in the EU would be more stringent than outside the EU. Technical guarantees are widely used in the real economy in order to secure national, intra-European and international commercial exchanges. Airbus relies on the issuing of such guarantees at the request of its governmental customers, mainly in its helicopters, defence and space businesses. The considered increase of the credit conversion factor (CCF) from 20% to 50% for any considered technical guarantee would mechanically lead Airbus’s fees payable to its banks for the issuing of technical guarantees to increase by 150%. On top of which, additional overcosts would result from the application of the 2 other considered measures (ie minimum 2,5Y maturity floor for any considered technical guarantee and increase of the CCF from 0% to 10% for undrawn facilities -credit lines- available for technical guarantees). Airbus has a current exposure of several billion EUR of technical guarantees issued by EU-based banks and has further undrawn credit lines with the same banks, also in the billion EUR class. In case of implementation, the EU regulation would represent a major cost increase of several millions EUR per year for Airbus, whose competitiveness would be directly impacted. Based on the arm's length principle, the strengthening of the requirements for technical guarantees on the bank side would impact as well the corporate undertakings that Airbus mother company regularly issues to support its subsidiaries instead of bank undertakings (pending agreement of the customer). The level of exposure of Airbus for corporate undertakings is 3 times its level of exposure to bank guarantees therefore the impact would also be significant from that perspective. In addition, the possible limitation of credit lines availability due to increased capital requirements on the bank side could also jeopardize our ability to meet our contractual obligations when technical guarantees are requested by our customers. This could put in particular our supply chain (to whom technical guarantees obligations are cascaded) at risk. The considered increase of the CCF from 20% to 50% for any considered technical guarantee is all the more surprising that the current 20% CCF requirement is already very conservative when taking into account the historical default rate under such technical guarantees - below 1% industry-wide. Based on this very low figure, and on the nature of the underlying risk (by essence, it is only dependent on the ability for the seller to perform the contract with its customer, as opposed to a degradation of its financial standing, and as such has no reason to increase in the future), further degrading the current conditions for technical guarantees makes limited sense.

Response to Development of an EU approach on Space Traffic Management (STM)

Airbus is a space business world leader, the only company with activities on the whole value chain, from access to space (through its participation in Ariane Group) to added value services, including the design and manufacturing of satellite systems and their operation in orbit. Airbus promotes a safe and sustainable use of space, because it is a sine qua non condition of the sustainable development of space activities. Airbus abides by space laws, standards and industry best practices i.e. safety, safe removal of satellite and vehicles at the end of their operational life, but is also pushing with the international community to go farther. For instance Airbus is actively supporting the development of the Space Sustainability Rating, and eco-label for space missions under the World Economic Forum aegis. This commitment goes beyond Airbus’ interest as a commercial organization generating revenues from the space domain, and it is in the interest of all to protect this natural resource, since space is vital to the daily life on Earth and the running of our societies – from weather forecasting to global connectivity, climate change monitoring and navigation, positioning and timing. In a competitive global environment, Airbus urgently calls for a level playing field where the highest standards of sustainability are applicable to all, for the benefit of all. Space traffic is fast increasing (the number of operational satellites has more than doubled over the past years because of the launch of large satellite constellations) and $certain orbits bringing operational advantages have become concentrated areas of space traffic. The increased use of space by all States and nongovernmental entities will only increase further the traffic. This triggers a potential for collision and debris generation with a domino effect that in the long term could jeopardize future use of key orbits. The sustainability of Space is thus key to global development and while in the short term measures on debris mitigation are already in implementation, a set of new STM solutions are needed. First of all it is mandatory to have access to an accurate and objective knowledge of the trajectory of all space objects that could have a significant effect in case of impact. No State (not even the US) has the capability to monitor current space traffic to this required extent. Europe needs instantly to develop a vision, on top of policy considerations and geopolitical concerns. Airbus calls on the Commission and the Member States to move to the next level as indicated in the Action Plan on synergies between civil, defence and space industries. The EU Strategy for STM (a flagship project) has to go much further than the initial SST capability steps that have been pursued at ESA and EU level. The SST capability should be way further developed, and many other issues have to be addressed such as launch notifications and traceability, cooperation with satellite operators, backtracking of historical launch remains, enforced safety measures against in-orbit fragmentation, deorbiting insurance and safety measures, as well as many other topics. Industry should be admitted into upcoming discussions on which architecture is needed for a global STM system and how the funding available for the SSA program under the European Space Program could be most efficiently used. Clear programmatic and technical goals (e.g. quantification of an object catalogue suitable to reduce collision risk to an acceptable level) for STM need to be defined as prerequisite to develop a useful and competitive European system architecture in an incremental approach. While the federation of national sensors is a reasonable first step, such a bottom-up approach will not achieve the required performance. Necessary developments therefore need to be coordinated between the participating countries. A network of data-gathering sensors on ground and in space is needed. Response to Instrument to deter and counteract coercive actions by third countries

European companies with international activities are increasingly exposed to extraterritorial regulations or acts of economic coercion from non-European countries. This is particularly the case with regard to the fight against corruption, international sanctions regimes, export control, search for digital evidence by judicial or regulatory authorities, or intrusive access to sensitive data of EU companies. These measures may pursue foreign policy objectives or non-European economic interests. This situation: - is a source of legal insecurity and economic vulnerability for European companies and creates distortions of competition and constraints to their detriment. - is reprehensible when a non EU State uses it unilaterally and for the purpose of leveraging foreign policy objective or collecting information. - is heavily penalizing since these measures induce major financial impacts and can lead to destabilizing the governance of European companies. Providing the means to deter and, if necessary, counter coercive policies and practices is essential from the point of view of EU strategic autonomy and level playing field. The main measures that we believe should be taken today are as follows: - a detailed report should be produced by the Commission or the European Parliament in order to take the exact measure of the subject: transversality, impact on companies and, therefore, on European strategic and economic autonomy. - formation at short notice of a “political office for European Resilience”, reporting to the highest European authorities, which could act as a control tower, detect and assess the risks or coercive actions across all the areas concerned, also factoring in specificities of each ecosystem (such as aerospace and defense), identify the possible means of deterrence or retaliation, also in a transversal manner, and if necessary allow better coordination of the action of the various Directorates General and Commission services. This unit could act as a privileged interlocutor vis-à-vis foreign authorities in addition to EU State administrations and assist European companies facing pressures or coercive actions. - adoption of an appropriate trade defense instrument: the European Union must be able to adopt deterring actions and, where appropriate, corrective ones to restore a balance of forces and find a positive and negotiated solution to situations of coercion. whether digitally (Cloud act) or as part of investigations or judicial or administrative proceedings, the most sensitive data of EU companies can be exposed. It is necessary to put in place the tools that would make it possible to respond to this risk without, however, hindering economic exchanges or hampering the ability of European companies to carry out their offensive or defensive legal actions. - With regard to the aerospace and defense sector, particular attention should be paid to the rules for export control rules (ITAR, EAR), which can constitute a very intrusive means of pressure or coercion. - The European blocking regulation N. 2271/96 (international extraterritorial sanctions) must be revised. In particular, European companies must be protected and not placed at the heart of the conflict between European and non-European rules, especially since China has just adopted comparable legislation. These measures will of course have to be based on a legal examination of the means available to the European Union in international law.

Airbus welcomes the Commission's Action Plan initiative on synergies between aeronautics, defence and space. In a rapidly changing international context and in the race for technological advances, supporting sectors that contribute to the EU's sovereignty and technological independence is key. Covid also puts our industry under huge pressure and significantly reduces our ability to invest in RDI. Finally, our industry will need, in all its branches, to innovate heavily to support the EU Green and Digital agendas. Public spending in Europe remains far below the level of the US and China, which provide massively higher civil, defence and space R&D budgets. Our competitors are active in both civil and defence sectors, with dual use products, software and technologies. Economic diplomacy needed to support civil aeronautics relies upon a geopolitical influence rooted in military power. Third countries such as the US, China and Russia also resort to national preference for major structuring tenders. This provides their domestic companies economies of scale which ensure their profitability and competitiveness on export markets, throughout civil and military activities. Designing a new ambition for the EU institutions, in coordination with national governments relying on a European preference and across civil and military industry is therefore needed to support a holistic approach to the European strategic autonomy. Our industry’s companies are part of a complex web of supply chains that spans across Member States and abroad, including numerous SME and mid-caps that specialise in technologies for application in all sectors and benefit from spillovers generated by our investments. Business and innovation models from the civil can be applied to the space and defence ecosystem to stimulate and implement leaner, more agile, cost effective, and user-centric rationales. Digital and other new emerging technologies offer huge potential for future synergies. Key examples and priorities of civil / military spillovers are identified in Annex 1. EU programs should foster synergies through a capability-driven approach: key programs must be defined so as to set up corresponding R&D actions. Implementation should be coordinated throughout EU programs. Bottom-up approaches with scattered, small scale investments must be avoided. The EU can hence best foster synergies and efficiencies through flagship programmes that will act as technological catalysts and drive the development of transverse capabilities, applications and ecosystems (see Annex 2). Contraction of the sector’s EU R&D budgets and budgetary flexibility between EU programs must be avoided to provide planning reliability to industry and Member States. Through their high technological level, Aerospace and Defence have significant repercussions on the whole EU civil industry and integrate innovations from one another (digital, hydrogen). Stringent product environment and conditions of operation pull upward the rest of the industry upwards and contribute to achieving EU environmental objectives through modernized manufacturing processes. Cross fertilisation could attract talents, upskill digital profiles and encourage the workforce to remain in the EU. EU policies, procurement and R&D programs for data, AI, cloud, digital platforms and related services shall integrate existing assets across domains of activity and sectors. This will reduce the time-to-market time through investment supporting Green and Digital priorities. A balance must be found on the openness of research results, IPRs, guarantees for risk investments, assurances of economic return. Emerging technologies will bring new challenges, e.g. for standardisation and protection of data. Finally, the European Commission’s proposal to limit the list of items that are subject to control within the EU to the most sensitive items is fully supported.
