Response to Digital package – digital omnibus

The launch of the simplification process within the forthcoming Digital Omnibus marks a pivotal step toward enhancing Europes competitiveness and reaffirming its leadership in digital regulation. Dassault Systèmes welcomes the European Commissions commitment to establishing a regulatory framework that is simpler, clearer, and more harmonized. This initiative represents a much-needed step forward to ease the regulatory burden on companies and to create an environment conducive to innovation. As an industrial actor deeply engaged in digital transformation and the pursuit of sustainable solutions, we fully support efforts to build a regulatory ecosystem that drives technological progress, strengthens industrial competitiveness, and safeguards European digital sovereignty. In this context, Dassault Systèmes puts forward the following recommendations: Recommendation 1: Establish a common template and a unique tool acting as a single entry-point for cybersecurity obligations related to incident and vulnerability notifications Recommendation 2: Introduce a 24-month moratorium on the enforcement of CRA manufacturers obligations following the publication of standards Recommendation 3: Strengthen the use of the existing European data acquis to stimulate innovation Recommendation 4: Ensure the non-retroactive application of contractual provisions under the Data Act Recommendation 5: Allow more flexible transition periods for switching providers Recommendation 6: Focus interoperability standards on IaaS in order to preserve innovation Recommendation 7: Introduce a moratorium on the application of the AI Act until the necessary standards and guidelines are available Recommendation 8: Clarify and balance responsibilities across the AI value chain Recommendation 9: Prevent regulatory overlap with sectoral legislation Recommendation 10: Clarify the scope of obligations for general-purpose AI (GPAI) models Recommendation 11: Ensure a fair and harmonized approach to software liability

Response to The EU Cybersecurity Act

As a European software company, Dassault Systèmes recognizes that robust cybersecurity is fundamental to ensure the integrity of digital operations and maintaining trust in increasingly interconnected industrial ecosystems. Committed to a unified European cybersecurity framework with ENISA at its core, Dassault Systèmes actively promotes high standards of security and resilience, supporting both innovation and the responsible use of digital technologies across Europe. Dassault Systèmes welcomes the Commissions public consultation on the review of the EU Cybersecurity Act (CSA). Adopted in 2019, the CSA marked a major step toward establishing a voluntary cybersecurity certification framework and strengthening the role of the European Union Agency for Cybersecurity (ENISA). However, the rapid evolution of cyber threats, the multiplication of regulatory frameworks (NIS2, CRA, DORA), and rising geopolitical tensions now call for a thorough adaptation of this framework. Dassault Systèmes recommends that the CSA is reviewed in order to: 1. Grant Europe with stronger cybersecurity capabilities in order to increase the resilience of EU Member states and companies 2. Allow a certification level where sovereignty requirements (i.e. immunity of products, services and access to information to extraterritorial laws) are taken into account 3. Accelerate the single market by harmonizing cybersecurity reporting policies

As a European company, Dassault Systèmes is committed to playing a proactive role in fostering innovation and the ethical use of AI in Europe. As a trusted partner to equally dedicated companies, we strive to ensure that AI benefits citizens, patients, and consumers. Dassault Systèmes welcomes the European Commissions ambitions through the Apply AI Strategy, which aims to position European companies as global AI leaders, enhance public sector services, and promote the integration of AI across strategic sectors. We also support the Commissions renewed emphasis on competitiveness and regulatory simplification, as well as the strong political commitment to reducing administrative burdens on businesses. To accelerate the uptake of AI in Europe, we believe it is essential to provide companies with a clear, coherent, and business-friendly regulatory framework. As the Commission undertakes efforts to streamline the broader digital acquis and advance concrete simplification measures, we wish to draw attention to specific obligations under the AI Act that, if clarified or simplified, could more effectively support Europes competitiveness in the global AI race. In the meantime, we suggest the Commission to consider a moratorium on the implementation of the AI Act to ensure the final framework is practical, proportionate, and allows European companies sufficient time and guidance to prepare for compliance.
