DER MITTELSTANDSVERBUND (SME Groups Germany) is the leading professional association of cooperations between small and medium sized enterprises. DER MITTELSTANDSVERBUND unites companies from the retail, crafts and services sectors as well as the production industry. DER MITTELSTANDSVERBUND represents around 230.000 independent entrepreneurs which are organized in about 310 groups. The legal form differs between the groups. Whereas around the half of the groups reside as registered cooperatives, the other groups are limited liability companies or stock corporations

Response to Revision of the Vertical Block Exemption Regulation

DER MITTELSTANDSVERBUND ZGV e.V. pleads for more possibilities for common price policies within groups of independent retailers. The impact assessment stresses the possibility to engage with businesses in discussions on concrete instances regarding the conditions under which efficiencies for RPM can be claimed and the evidence that is required to satisfy the conditions of Article 101(3) TFEU. Groups of independent retailers clearly need the possibility of a common price policy in order to achieve a coherent communication with views to the consumer. This will lead to better retail services of these groups of independent retailers and contribute to a diverse and balanced retail landscape.
