Response to Evaluation of six Euro-Med FTAs

EuroMed Rights recommends to the European Commission, in particular: 1/ To specify the methodology to be adopted for assessing “social (including employment), human rights, and environmental impact on each of the partner countries and the EU”; 2/ To make a comprehensive evaluation including both direct and indirect consequences that Free trade agreements (FTAs) have on the capacities of partner States, as well as the EU member states, to guarantee economic and social rights of their citizens; 3/ To ensure that free trade agreements are not negotiated or adopt without broad and participatory consultations undertaken with civil society; 4/ To ensure the independence of the evaluators. Economic, social and human rights as well as sustainable development are fundamental elements of the Association Agreements. However, economic and social imbalances are still far from being settled for a majority of the region’s population. Although the Arab uprisings called for social justice and for improvement in economic conditions, they did not bring about changes in the negotiation of new FTAs or the economic policies underlying the current agreements. In a report published in 2015, EuroMed Rights highlighted potential negative effects of a DCFTA on the economic and social rights in Tunisia. In 2016, EuroMed Rights issued a regional report exploring how the EU’s economic and financial policies towards its neighbours, before and after the Arab uprisings, affected the economies of the South Mediterranean countries (SMCs), and that no due considerations was taken about the impact of these policies of citizens’ enjoyment of human rights. Since the launch of the ENP in 2004, references to job creation, labour rights, and gender equality have been included in ENP Action plans and other strategy papers, However, the EU policies’ strong focus on economic reform, liberalisation and structural adjustment, combined with restrictive migration policies focussing heavily on preventing irregular migration, remain intact. The negotiations of DCFTAs risk reinforcing this trend and further erode the respect for economic and social rights principles. Also, trade and financial relations between the EU and the SMCs did not witness a substantial change or transformation in recent years. Trade exchange across the Mediterranean is still characterized by large asymmetries between North and South. EuroMed Rights’ report highlights important gaps in the knowledge and understanding of the relation between human rights and economic-financial flows and policies. Therefore, EuroMed Rights calls on the European Commission to take this evaluation as an opportunity to provide a better understanding of the relations between the FTAs and their impact on human rights. The European Commission evaluation should take into account the following: The impact of liberalisation on working conditions, job quality and social protection; The effects of agricultural trade liberalization; The impact of the FTAs on SMC citizens’ standard of living including right to adequate food, housing, clothes and right to water and sanitation which could be linked to trade liberalisation; Gender differentials with respect to wages and employment; The social protection and working conditions of SMC migrants in the EU; The environmental effect of trade liberalisation on the SMCs; The impact of the EU-funded programmes supporting SMC reforms in different sectors such as education, health or promotion of social dialogue on the life of SMC citizens and their economic and social rights.
