Response to Combating child sexual abuse

Save the Children Europe, representing several Save the Children members, welcomes the recast of Directive 2011/93/EU and many of the updates made in the proposal by the European Commission. Overall, the updated Directive will be an important step in ensuring that legislation in the EU protects children and their rights and that laws are able to keep up with the technological aspect of the sexual abuse of children, in particular in the digital environment. We are, however, concerned that the definitions of child sexual abuse material (CSAM) and child sexual abuse have some shortcomings. For CSAM, it is crucial to ensure that the definition is clear and sufficiently covers the material that sexualises children and violates their right to protection. For child sexual abuse, it is important that offences, where the perpetrator is not in the same physical space and instead instructs the child via a digital device, are clearly included. Furthermore, we welcome the addition of a clearer mandate for organisations acting in the public interest against child sexual abuse, such as INHOPE hotlines, with some suggestions for further inclusions. When it comes to consensual sexual activities between peers, we find it concerning that the proposal does not create minimum standards for protecting children from criminal prosecution. Finally, we offer suggestions for clarifying the exemption from the reporting obligation for professionals working in the context of programmes dedicated to offenders or people who fear that they might offend.
