Response to Digital Fairness Act

The European Federation of Associations of Health Product Manufacturers (EHPM), registered on the EU Transparency Register (No. 65512466920-96), welcomes the opportunity to contribute to the European Commission Public Consultation on the Digital Fairness Act. EHPM fully supports the objectives of the Digital Fairness Act, which seeks to strengthen consumer protection in the digital environment by addressing manipulative online practices, misleading marketing, and non-transparent commercial communications. In this context, EHPM emphasises the importance of enhancing enforcement against misleading digital marketing and recognises that non- compliant products originating from third countries constitute a form of unfair competition for EU- based Food Business Operators (FBOs). It is important to note that advertising via social media, including influencer marketing, is an increasingly common practice among businesses operating in the EU. EHPM and its members are therefore are actively engaged in developing and updating Specialised Advertising Guidelines for commercial communications on social media as well as training programmes for influencers with a particular focus on protecting minors, in line with the objectives of the Digital Fairness Act. However, EHPM is concerned about proposals that conflate food supplements with harmful products and services, which is undermining the integrity of EU law, EFSA Opinions and could unduly burden already highly regulated compliant EU food supplements business operators, most of which are SMEs. Response to Import conditions and border controls of trade samples and certain composite products

The European Federation of Associations of Health Product Manufacturers (hereinafter, EHPM), is the EU stakeholder representing the food supplement sector since 1975. EHPM would like to submit its contribution in the context of the consultation on the proposed draft delegated act on border controls for food – import conditions and border controls of trade samples and certain composite products. The EHPM welcomes the possibility to provide feedback on the draft delegated regulation with which the European Commission (EC) proposes to add the CN Code for vitamin D3 to Article 3 of Delegated Regulation (EU) 2019/625. This proposed measure would have a major impact on food business operators as well as on public health. EHPM prioritises safety, high-quality standards, clear information to consumers and transparency of the EU food safety system. Please find our contribution enclosed.
