Response to A Culture Compass for Europe

The European press publishers associations EMMA and ENPA recognise security, strategic autonomy and competitiveness as values informing the cross-sector agenda of the Commission and believe that the press, as a key player in the media and information landscape, has a crucial role to play in the development of a strategic approach to culture. The European press sector offers professional content with high standards of quality, backed by self-regulation, checked by professional journalists and editorial teams, and published under editorial responsibility. Therefore, it is at the forefront of defending information sovereignty and integrity, European values as well as democracy and should be considered an integral part of the solution to the current challenges. Please find our recommendations below and our priorities for the current mandate attached. The free press is part of the Cultural and Creative Sectors (CCS) and must be included in the strategic approach to culture. Professional European press publications are cornerstones of freedom of expression and democracy, and as such should be adequately supported. The private press sector is essential for guaranteeing citizens access to pluralistic information and the promotion of European values. The Culture Compass should consider the media in their entirety and media policy as defined in the EMFA. The EMFA already provides a definition of media service provider and some safeguards for media freedom. Also, the Copyright DSM Directive, DSA, DMA and AI Act all contain provisions directly impacting the press and other CCS and should therefore be applied consistently with the objective of supporting European human-made content. The press sector should remain part of Creative Europe. Any public support must cover newspapers and magazines alike and, in line with Art. 25 EMFA, be content-neutral and awarded in accordance with transparent, objective, proportionate and non-discriminatory criteria. Nevertheless, the Culture Compass should include a clear holistic competitiveness strategy for media, with the goal of creating suitable market conditions for the media to be financially sustainable online and offline. Such strategy must take into account the medias vital democratic role for, that might justify a special treatment in light of the detriment to society if they were to disappear or become inaccessible. Overlapping or collateral effects of legislation from different policy areas that undermine the business models of the free press must be reversed and avoided. Financial sustainability is a precondition for an independent, competitive and pluralistic media landscape. The Culture Compass should highlight the legitimacy and necessity of sustainable business models, including based on subscriptions and (targeted) advertising, especially in light of competition by AI models that scrape content and stir resources away from professional media and creators and gatekeeper platforms that distort digital markets. The Culture Compass must clearly support copyright and related rights, a fundamental right under the EU Charter and an indispensable protection of and incentive for human creativity and innovation. As professional human-made content is also relevant for quality AI, the Compass must underscore that the complementary principles of transparency, consent and fair remuneration of rightsholders ought to be central to AI development. We see a connection between the Culture Compass and the European Democracy Shield, that shares the goals of protecting the European information space and democracy. EMMA ENPA will also contribute to the EUDS consultation to ensure that professional European media that comply with Art. 2 EMFA are recognised as important instruments against foreign interference and information manipulation. A democracy that fails to trust, support and protect its own media weakens itself from within.

Response to Digital Services Act: deepening the Internal Market and clarifying responsibilities for digital services

EMMA and ENPA’s Position paper on the proposal for a Regulation on a Single Market for Digital Services (COM(2020) 825) – hereafter the Digital Services Act (DSA): 1. Editorial platforms must be explicitly excluded from the scope of the new obligations of Chapter III DSA as they jeopardize the freedom of the press and editorial freedom Newspapers and magazines depend on the possibility to offer third parties, their readers, the ability to comment or contribute to comment sections, editorial forums and communities in the context of their publications. These offerings are intermediary services according to the DSA. Such services are not merely optional add-ons that can be discontinued without any effect on the publications’ journalistic and economic success. Rather, they are usually integral parts of the publication, indispensable to enable readers to engage in discussions with each other and with the editorial team. The proposed content control obligations of Chapter III DSA would create disproportionate and impossible burdens for those editorial platforms and jeopardise editorial freedom. These platforms generally don’t provide any direct revenue to publishers and therefore any additional burden would render them impossible to operate. As a result, spaces for qualitative and serious discussions online would be diminished and the gatekeeper platforms would entrench their control over the formation of opinion online. We therefore call on all decision makers to exclude all editorial platforms from the scope of these obligations. 2. The DSA should not legally legitimize the arbitrary exclusion of legal publications from distribution on very large platforms Digital platforms are increasingly indispensable distribution channels for the free, digital press. This is especially true for so-called gatekeeper platforms which play an important role in shaping the public opinion. Such gatekeeper platforms should not be allowed to exclude legitimate publications from public discussion on the basis of general terms and conditions. Publications which are legally available offline must also be available online on very large platforms. Already today, these gatekeepers often decide arbitrarily which publication has a chance on the readers and advertising markets. It is therefore an essential prerequisite for the preservation of a free and pluralistic press to ensure fair and non-discriminatory distribution of all digital press publications on gatekeeper platforms. Instead of restoring or ensuring non-discriminatory distribution of press publications on gatekeeper platforms, however, the content control obligations, including those targeted for very large online platforms of the DSA would legitimise the fact that the boundaries of press freedom on those gatekeeper platforms are no longer the general laws, but the terms and conditions of gatekeeper platforms. Therefore, what is legally available offline must also be legally available online on gatekeeper platforms. In addition, all legal editorial publications should be distributed in a non-discriminatory manner.

Response to Measures to further improve the effectiveness of the fight against illegal content online

EMMA (the European Magazine Publishers’ Association) and ENPA (the European Newspaper Publishers’ Association) represent together thousands of newspapers and magazine publishers over 10 thousands titles through national associations of 21 European countries and constitute the widest representation of press publishers at European level. As regards tackling illegal content online, press publishers find themselves in a very specific situation in that they are on the one hand content providers, and on the other hand hosting content provided by others. Indeed, the press publishing sector has on the one hand an interest in ensuring that its content is not illegally distributed. It is essential that the digital press has both a practicable right enforcement of copyright against illegal copies of press products or parts thereof. On the other hand, as hosting service providers, the press is also impacted by measures tackling illegal content online as they are through their websites hosts of alleged illegal content (for example on a discussion forum of a newspaper or magazine publisher’s website). Our concern is that a too far-reaching responsibilities for press publishers’ websites, especially on their forums would not only impose important administrative and financial burden on the sector but also considerably diminish the necessary freedoms of the digital press. Press publishers, should be excluded from European legislation that would force them to monitor or even censor posts of users in general as they are already subject to national legislations reflecting national sensitivities and culture with regard to illegal content (for example Law n°2004-575 in France and the “NetzDG” law in Germany). We believe that these sensitive questions should not be dealt with at EU level as far as press publishers are concerned and that they should remain outside of the obligations mentioned in the “EC Inception Impact Assessment”.

Response to Evaluation and potential revision of the EU tyre labelling scheme

ENPA, the European Newspaper Publishers’ Association and EMMA, the European Magazine Media Association would like to submit comments in connection with the impact assessment that will be carried out on the EU tyre Labelling scheme. In the preparatory study from Viegand under point 10 (“recommendations”) it is indicated that to help end-users make an informed choice when purchasing tyres, one solution among others could be “the inclusion of information about the label performance parameters in advertisements including the now omitted advertisements in billboards, newspapers, and magazines.” Whereas EMMA and ENPA supports the efforts of the European Commission to improve consumer patterns it is important for press publishers to stress that an advertising focused approach would be erroneous in view of the pursued objective. Essentially, we believe that advertising is not the right place to insert detailed information about a product as the limited space does not allow for the provision of all the information necessary to the final purchase decision. Information is perceived to be much more useful when provided at a later stage through websites, in information brochures or at the point of sale when the consumer is in the process of comparing products and services. This observation should be further balanced by the fact that other crucial elements influence the behaviour of consumers, namely the price of the product. The current Regulation 1222/2009 on the labelling of tyres follows the logic of clearly differentiating advertising from technical promotional material which can be really effective when it is provided at the relevant moment, that is to say when the decision to purchase is made. For all these reasons press Publishers would rather endorse non-legislative action to improve the implementation of the scheme with a focus on more enforcement action. As the Viegand Study points out under section 8.1.1, the majority of end-users (56%) where not provided with information by the car dealer before purchase which shows that there is room for considerable improvement in terms of providing pre-sale information. Additionally, raising more awareness with the consumer should be the priority. In that respect press publications are instrumental in shaping public opinion towards energy-conscious living through its editorial content. However, introducing advertising restrictions threatens the financing of the free and independent press and is counterproductive in the context of a successful energy efficiency policy. ENPA and EMMA are looking forward to a constructive discussion with the European Commission in connection with the upcoming impact assessment and will contribute to the public consultation that will be opened in the course of fall.
