Response to Creation of the Common European Mobility Data Space

EPTO welcomes the initiative to create a common European mobility data space provided that this does not impose additional material costs on public transport operators, there is a level playing field for all public transport operators in terms of any data provision obligations, and there is no obligation on public transport operators to submit any commercially sensitive data.

Response to Better protection for passengers and their rights

EPTO supports the concept of fair and reasonable rights for public transport passengers. In formulating any changes to the existing passenger rights for travellers by rail and by bus and coach, the Commission must remain mindful of the potential impact of any measures that provide for additional compensation or replacement services for passengers. Where these result in additional cost and risk for service providers, there is likely to be an increased cost to contracting authorities or, for commercial services, directly to passengers. This would not be a desirable outcome, for instance, where the impact on of the incident on affected passengers is low, for instance on a frequent local bus service where cancellation of, or delay to, a journey has little direct impact. There is also a need to ensure that any compensation is appropriate to the cost of the journey. If consideration is given to passenger rights on multi modal journeys, there is a further consideration. For instance, the need to refund a flight cost where a local bus has become delayed by traffic congestion and the passenger has missed their flight, would increase the bus operator’s cost and risk disproportionately. Such cost and risk could be more reasonably mitigated by the passenger having made more appropriate travel plans and/or taken out appropriate travel insurance for the high value leg of the journey. The cost implications of the operator passing that risk on to a contracting authority, or directly to passengers, would be disproportionate – indeed the risk may be deemed too high to continue provision of the service. The Commission is urged to take note of such issues when reviewing passenger rights for local travel.
