JLR Urges Longevity Focus in New Vehicle Recycling Rules

Message — JLR suggests prioritizing vehicle longevity through reuse and remanufacturing rather than focusing primarily on recycling. They request that post-industrial and chemical recycling count toward mandatory recycled content targets.12
Why — Broadening the definition of recycled content helps the company meet targets despite quality shortages.3
Impact — Consumers may experience reduced vehicle quality and noise issues from mandatory dashboard dismantling.4

Message — JLR requests a 36-month lead time following the final legislative agreement. They recommend including CO 2 normalization to account for towing heavy payloads. On-board monitoring mandates should be postponed until the technology is proven.123
Why — A delay would reduce immediate compliance costs and protect investments for electrification.45
Impact — Vulnerable populations lose as the requested delay postpones improvements in air quality.6

Public submission by Jaguar Land Rover Limited. Jaguar Land Rover (“We”, “our”) supports “true” technology neutrality and seeks a world-wide solution in order to maximise safety and efficiency for the benefits of the Collaborative-Intelligent Transport System (C-ITS) framework. At this stage the European Commission is racing to adopt a Delegated Act on C-ITS, which in our opinion does not entirely reflect those above-mentioned principles. As per its final draft, the Delegated Act favours a “hybrid communication” solution on the basis of concepts such as “maturity” (as per art.3.3) which are not clearly defined in the body of the regulation. At present, other solutions able to maximise benefits integrating short and long-range communications within a unique domain are deemed as mature, tested and adopted in other markets. We envision a clear need for a transparent process in regard to the assignment of assessment criteria for new services and technologies which should not be limited to one solution (ITS-G5), but seeking to include LTE-V2X (short and long range communication) and the forthcoming 5G. Jaguar Land Rover reiterates the position that the Delegated Act should not be choosing a technology winner, but should allow a landscape with equal opportunities for all automakers, suppliers and other stakeholders aiming to support the deployment of C-ITS. In a fast-changing technological environment, a “wrong” choice would therefore hinder further innovation, reduce market competitiveness and slow progress towards the intended benefits until a review of the regulation will be carried out (Article 33.1, “three years after the entry into force of this Regulation”). Thus, we invite the European Union to take a longer-term, wider view which means working with other countries such as China and the United States in order to provide a harmonised legal framework for the quick, safe and reliable deployment of these solutions; if necessary, delaying the publication of the Delegated Act until a comprehensive evaluation will be made.   In addition to our main vision, below are further details referring directly to the Delegated Act: 1. Explanatory Memorandum, Paragraph 3.3 - “Maximising benefits involves leveraging the distinct advantages of different, complementary technologies.” We disagree that the different complementary technologies offer distinct advantages over a technology that can be used for both long range and short range communications. 2. Explanatory Memorandum, Paragraph 3.3 – “The practical implementation of the hybrid communication approach, combined with the need to ensure the interoperability and continuity of services, imposes certain technological choices. These are reflected in a minimum set of functional and technical requirements for the interoperable exchange of messages between C-ITS stations. As this should not hinder further innovation, this Regulation ensures that future technologies can be integrated in the ‘hybrid communication’ mix. A review clause will facilitate the integration of several existing candidates, such as LTE-V2X (a cellular-based short-range communication technology) and 5G, the set of technologies for next-generation cellular networks.” We do not agree with the need to rush to adopt a regulation that clearly favours a certain technology, retrospectively demanding interoperability. We do believe that the adoption should be subsequent to the evaluation of both technologies. Having two receivers adds extra cost & testing & certification; not only for OEMs but also for road side furniture or any other node within the V2X eco-system.

Response to Real-Driving Emissions in the EURO 6 regulation on emissions from light passenger and commercial vehicles (RDE3)

Jaguar Land Rover (JLR) has put significant investment and effort into preparing for the introduction of RDE legislation. However, sufficient lead-time is vital to allow industry to adjust to legislative changes; we are subject to long development, R&D and manufacturing cycles. Preparation for RDE is all the more challenging as we are faced with incomplete legislation. Two separate RDE Regulations (March/April 2016) have required intensive planning and investment to bring forward our development plans to make new models RDE compliant from September 2017. Suppliers have now been assigned, contracts made & vehicle designs completed. RDE package 3 introduces two significant new measures proposed to apply from 09/17 that the EU hopes to approve in the regulatory committee on 20/12/16, with expected final publication in April/May 2017. The European Commission is, effectively, proposing major legislation that will give industry only 4 to 5 months lead-time to comply. Such agreement sets a poor example; industry needs certainty of legislation, time to implement changes in our manufacturing plans and regulatory stability. Jaguar Land Rover also kindly requests the following points are achieved: • Confirmation of the “Option 0” cold start approach for RDE. • Any further changes to the evaluation tools required to address concerns around compatibility with Option 0 need to be finalised by the end of 2016 as part of package 3. Further, this should include any review of the two alternative methods set out in Appendices 5 and 6 to Annex IIIA to Regulation (EU) 2017/xxx with a view to developing a single method. • RDE and WLTP are fully ‘decoupled’, resolving the contradiction brought about by WLTP’s introduction of new emissions types, so that the agreed introduction dates for RDE Step 1 are not interfered with (09/17 and 09/19). • RDE package 3 should be decided by the end of December 2016 so that the legislation is fully complete, robust & accurate. • No further tightening or changing of the RDE legislation except those steps already agreed or where the details of the regulation must be improved for robustness. • Further adjustments on the RDE boundary conditions for LCVs & other RDE issues to be tackled as mentioned in RDE package 2 should be addressed in RDE package 4 without delay. • PN-PEMs instruments must improve & a suitable error margin greater than 0.5 must apply for PN instruments. • All PEMs instruments should be approved & COM should take steps now to introduce a PEMs approval process that should be ready by end-2017. • The quality of market fuels must be taken into account & improved to help reduce real driving emissions. Industry needs predictability when new regulations are adopted; we need time to implement changes which have major implications for manufacturing and we need regulatory stability to generate a reasonable return on our major investments. We trust we will get support from the legislators to ensure that we have the time that we, and our suppliers, all need to start implementing the new RDE package 3 requirements on future vehicle models from RDE introduction.
