Response to Digital Product Passport (DPP) service providers

Michelin welcomes the call for evidence on a delegated act laying down rules on the operation of DPP service providers within the digital product passport. Indeed, Michelin, as a tyre manufacturer, will issue Digital Product Passports for the tyres it markets in Europe and will need to entrust copies of these DPPs to a DPP service provider. Michelin may also prescribe DPP service providers to its franchisees to ensure regulatory compliance. Additionally, Michelin is a founding member of the GDSO, the tyre industry data space, which could act as a DPP service provider for tyre industry players. In that respect, Michelin has identified 4 risks associated with DPP service providers activities. Therefore, Michelin supports the Commission's efforts to establish a harmonized, fair, and secure framework for DPP service providers and recommends the following to mitigate the identified risks: Risk of regulatory non-compliance if the DPP management activities by service providers do not comply with the CEN/CENELEC harmonized standards of the DPP. Recommendation 1: Considering that it is in the economic interest of the DPP service provider to ensure regulatory compliance for its clients, Michelin believes that a self-certification requirement to CEN/CENELEC standards is sufficient. The delegated act could specify self-certification compliance with CEN/CENELEC standards. Voluntary third-party certification appears as commercial proof of the seriousness of the DPP service provider's offer. Risk of monitoring economic operators' activities by DPP service providers. Recommendation 2: Overall, the DPP service provider's activities share similarities with those of a data intermediation service provider. To ensure the non-monitoring of activities by DPP service providers, certain requirements of the Data Governance Act could apply to them. Risk of leakage of sensitive business data for economic operators' activities if the cybersecurity level of DPP copy storage by service providers is not adequate. In fact, certain events in the tyre's life, such as retreading, impact the tyre's sustainable performance and lead to updating the DPP of the new product. Identifying the tyre individually, through a serialized identifier, is necessary to ensure good traceability of these key events for sustainability. However, using serialized identifiers increases the sensitivity of DPP information as their aggregation provides indications on economic operators' sales in Europe. Recommendation 3: The appropriate level of cybersecurity must be guaranteed by service providers hosting "serialized" DPPs. DPP service providers would be categorized by the NIS2 directive as important entities. It includes a "High" level of the future EUCS for Cloud hosting and "IG3" level of CIS security controls for on-premise environments. In that respect, Data hosting in Europe is essential. An ISO27001 and SOC2 type 2 certification should be implemented, with the certification scope covering the data hosting and processing scope by the DPP service provider. Furthermore, Michelin draws the authorities' attention to the interest of a reinforced "high+" security level of the future EUCS. Indeed, the interest of economic operators in using DPP providers relying on the Cloud could be examined from the perspective of a "High+" standard protection level of the EUCS, fully guaranteeing European sovereignty over data related to the European economy. Risk of non-financing of DPP service providers' activities in case of economic operator market withdrawal: Recommendation 4: Alternative revenue sources must be possible to avoid DPP and backup copy storage being financed solely by the consumer. Professionals benefiting from the information system could contribute to its operation through taxes or FRAND remuneration. In case of market withdrawal of an economic operator, DPP service providers could be remunerated through data access by circular economy professionals
