Response to Guidance on tackling disinformation

Schibsted is submitting some initial feedback to the Commission's roadmap on the future guidance for strengthening the Code of Practice on Disinformation. Although we fully understand the challenges with disinformation and the impact such content may have on our societies, we are extremely sceptical of the Commission’s intention to create a “true co-regulatory instrument”. Schibsted cannot accept any kind of sanctions linked to content that is NOT illegal, although it may be in the form of harmful disinformation. All forms of public sanctions, directly or indirectly aimed at legal content, would constitute a restriction of freedom of expression. However, it may be acceptable to increase transparency and reporting requirements related to the guidelines contained in CoP. Based on our experiences with national press-ethical systems, we believe that self-regulation is best placed to regulate legal content. We call on the Commission to continue facilitating a self-regulatory approach for disinformation rather than moving towards co-regulation that would have far greater implications for freedom of expression and would lead to national discrepancies. We therefore think that the Commission should facilitate the development of the Code of Practice together with the social networks and not leave it to national authorities or their EU organisations. We understand the rationale behind developing the mechanisms around finding and financing disinformation, but would caution against any measures that require defining what is disinformation in a co-regulatory code. Any definition that would be interpreted by national authorities could lead to fragmentation and arbitrary and politically motivated assessments. In particular we are worried that disinformation would be interpreted and assessed by social networks in relation to editorial content or that having national media authorities scrutinize the Code of Practice could have spill-over effects on editorial content by national publishers. Editorial content is already regulated on national level by constitutional laws, press-ethical systems and the editor-in-chief of the publication is ultimately liable for the content. Social networks should not be able to take down editorial content based on their terms and conditions or any code that they may be signatories of and therefore it is of utmost importance that an updated Code of Practice includes an exemption of editorial content from its scope. It is therefore important that the Code of practice is scrutinized on EU level by the EU Commission as it is today. This is just as important as supervision in relation to illegal content should take place at national level. The signatories of the code are mainly global social networks and disinformation is a global and EU-wide challenge that can only be dealt with on EU level. We would therefore conclude that the guidance of the Code of Practice should lead to an updated self-regulatory framework that is scrutinized by the EU Commission.
