Classifieds Marketplaces Europe is a coalition of industry-leading EU-based tech companies including Adevinta, OLX Group, Schibsted, Vinted, CustoJusto, and Wallapop operating online classifieds platforms in 21 European countries. Our aim is to empower citizens to strengthen the circular economy and local communities. By combining our resources, we are raising awareness about the specificities of the online classifieds sector and its positive contribution to key objectives of the EU digital and green agenda. We understand that the scope of the evaluation is the relevance of the DAC and its amendments (DAC2 to DAC6). However, we would like to share input on its 7th amendment as being the most relevant to our members. While CME supports the objectives of the DAC7, considering it a crucial step towards fostering simplification and tax transparency, in the markets where the law is being implemented, we are currently witnessing its negative impact on second-hand trade between private individuals, who are highly unlikely to have any ultimate tax obligation related to their trading activities on CME members marketplaces. Classifieds Marketplaces Europe Urges Flexibility for Recall Notices

Response to Sustainable Products Initiative

Members of Classifieds Marketplaces Europe (CME) operate online marketplaces across 17 European countries where we empower our users to reduce their purchase of new products by promoting circular consumption choices. By selling their pre-owned goods, our users play an active role in enabling the circular transition. Therefore, CME welcomes the proposal for a Regulation on Ecodesign for Sustainable Products (ESPR) that we believe will empower the consumers in the green transition. However, to ensure that online classifieds marketplaces can continue to play an active role in the circular transition by fostering the sale of second-hand goods, it is paramount that the following two elements are carefully considered before the ESPR is finalized and enters into force. Firstly, we strongly encourage the Commission to establish a unified scope in legislation that regulates online marketplaces. Obligations on online marketplaces introduced in the ESPR, the Digital Services Act (DSA), and the General Product Safety Regulation (GPSR) must be easily understood and aligned in scope, while simultaneously not duplicating or contradicting the obligations of each initiative. As part of this call for legal coherence, we call on the Commission to clarify the new definition of ‘dealer’. As defined in Article 2(56), it is not clear from the text whether ‘online marketplaces’ themselves should fall under this definition: “a retailer or any other natural or legal person who (. . .) displays products to customers in the course of a commercial activity, whether or not in return for payment”. Given that Article 29 already sets out the obligations of online marketplaces, we urge the Commission not to impose obligations beyond those specifically intended for our businesses. In addition, to ensure legal certainty in this matter, we suggest conceptually aligning a new definition of ‘dealers’, as introduced by ESPR, with the established definition of ‘traders’, as defined by the DSA in Article 2(e). Further to promoting overall legal coherence, CME urges the Commission to apply a common definition of online marketplaces in all legal proposals that exclude C2C trade. Trade between private individuals is not of commercial nature and excluding this would be consistent with the recently agreed wording in the DSA as well as the definition adopted in the IMCO Committee report on GPSR. Secondly, to promote the uptake in the sale of second-hand goods, it must be easy for consumers to trade. We generally welcome the proposal to introduce a Digital Product Passport (DPP), which could promote easier and safer trade on online marketplaces by facilitating more comprehensive information about sellers’ products. However, we would like to better understand the implications and scope of the proposal as regards second-hand products. We understand the Regulation mainly applies to products placed on the market for the first time. In case certain requirements for information on economic operators (Article 30) would also be applicable to second-hand trade, it would be important to provide more flexibility for second-hand products, for which the seller may not have all the required information, in order to avoid any undesirable side-effect of losing a significant number of second-hand transactions. By addressing the issues outlined above and taking the specificities of online marketplaces into account, CME would be able to keep contributing to a greener Europe and empower consumers to be at the forefront and drive the green transition.

Response to Promoting sustainability in consumer after-sales

The Coalition Classifieds Marketplaces Europe (“Coalition”) is a group of EU headquartered companies, including Adevinta, OLX Group, and Schibsted, operating online classifieds platforms that connect buyers and sellers to safely, easily, and conveniently exchange goods and services in their local communities. From furniture to fashion, from cars to collectibles, from real estate to jobs. The coalition welcomes the opportunity to give feedback to the public consultation and call for evidence on the right to repair. As Classifieds Marketplaces, we foster a culture of reuse and repair, given that consumers and businesses sell and buy second-hand goods on our platforms. Circular consumption and extending the lifespan of products is in our DNA. By giving previously owned goods a new purpose, we help to extend the lifecycle of products and allow consumers to make a positive impact on the circular economy. We are of the view that with the European Commission promoting sustainable consumption of goods by promoting repair and reuse the opportunities to increase the take-up of second-hand goods and repaired products will be on the rise. As classifieds marketplaces, we provide the right platforms for all to sell and buy these products. We therefore support the main objective of this initiative, to encourage consumers to use consumer goods for a longer time, by repairing defective goods and by purchasing more second-hand and refurbished goods. Recently, also the European Parliament has called upon the European Commission to consider repair requirements in upcoming files that govern product design and consumer rights, from the Sustainable Products Initiative to the Right to Repair. This might include measures such as labelling to inform consumers about repairability, furthering the life-cycle of products, or incentivizing consumers and traders alike who favour repairs and second-hand goods. Encouraging people to consume more sustainably and reduce waste fits our ambitious efforts to foster a circular economy to help mitigate climate change, and we therefore support these initiatives.
