Response to Evaluation of the Motor Vehicle Block Exemption Regulation

To the European Commission, The Swedish Association of Motorcyclists (Sveriges MotorCyklister, SMC) wants to express its concerns with the current Block Exemption Regulation 461/2010. The task of the Block Exemption Regulation is to ensure free competition on the motor vehicle market in terms of access to information, the possibility of servicing motor vehicles under warranty, access to spare parts, etc. Our point of concern is that motor vehicles with two wheels are currently not covered by the regulation. In CHAPTER 1 COMMON PROVISIONS Article 1 Definitions, there is under section g indicated: (g) "motor vehicle" means a self-propelled vehicle intended for use on public roads and having at least three wheels; The description that motor vehicles are defined with three wheels and above excludes motorcycles from free competition and allows manufacturers, importers and brand dealers to void the warranty if a motorcycle has been serviced (not repaired) by an independent motorcycle workshop. Furthermore, we have experienced that when a used, newer motorcycle under warranty is resold by an independent motorcycle dealer, the remaining warranty is removed from the motorcycle, which means that the customer no longer has a warranty on his motorcycle. Therefore, we propose that in CHAPTER 1 COMMON PROVISIONS Article 1 Definitions, point g the indication of the number of wheels is removed and will in the future say: (g) 'motor vehicle': a self-propelled vehicle intended for use on public roads. Response to Revision of EU legislation on end-of-life vehicles

Hej! Härmed vill jag skicka in Sveriges Motorcyklister (SMC) bidrag till EU:s Förordning om uttjänta fordon och typgodkännande. SMC ser positivt att det finns ett proaktivt arbete för att förbättra miljöarbete och återvinning av olika fordonslag och strategiska komponenter. Tyvärr är motorcyklar inte ett problem i Sverige där återvinningen och återbruket är ganska hög för varje motorcykel som säljs eller importeras till Sverige. Förslaget begränsar kraftigt den enskildes äganderätt samt en administrativ överbelastning kommer att tvinga mc-återvinningsföretag att stänga eller sluta med återvinning av mc-delar. Response to Revision of the Directive on Driving Licences

Hej! Sveriges MotorCyklister (SMC) har tagit del av EU Kommissionens förslag till ett nytt körkortsdirektiv om vissa körkortsåterkallelsers effekt inom unionen. SMC konstaterar besviket att inga ändringar har tillförts gällande delen som berör körkort för motorcyklar och mopeder trots många inspel under åren från SMC och andra nationella motorcyklistförbund. SMC ställer sig dock positivt till förslaget om vissa körkortsåterkallelsers effekt inom unionen. Med den kontinuerligt ökade rörligheten inom EU är det givetvis även viktigt att skapa bättre möjligheter att gemensamt kunna beivra trafikförseelser, oavsett var de sker och oavsett nationaliteten hos den som gör sig skyldig till förseelserna. I den bifogade fil förtydligar SMC flera kommentarer kring kommissionens förslag till ett nytt körkortsdirektiv om vissa körkortsåterkallelsers effekt inom unionen. Response to Approval of automated vehicles and of systems intended for such vehicles

Sveriges MotorCyklister är positiva till ökad trafiksäkerhet i en vägmiljö där alla fordon beaktas och samexisterar – dagens manuella bilar, motorcyklar, lastbilar, mopeder, bussar och veteranfordon parallellt med framtidens mer eller mindre autonoma fordon. För SMC är det ytterst viktigt att den tekniska utvecklingen inte sker på bekostnad av oskyddade trafikanter. Alla tekniska system måste kunna upptäcka små och icke-uppkopplade fordon som motorcyklar och mopeder.

See attached file with facts, stats and arguments why compulsory PTI for motorcycles and mopeds in Europe will neither improve environment, nor road safety. Instead it will increase the risk of serious accidents among moped riders, it will create huge cost and unnecessary bureaucracy.

Response to Revision of the Directive on Driving Licences

SMC, Sveriges MotorCyklister (the Swedish Motorcyclists’ Associations) represents 150 000 motorcylists in Sweden which is 25 % of the motorcycle owners in Sweden. The goals for SMC are to make it possible for users of powered two-wheelers to ride their motorcycle in an appropriate way with freedom of choice of how, when, where and which motorcycle to use today and in the future. It is very important to make motorcycling as safe as possible and affordable. Training, education, and testing are important matters when it comes to safety, affordability, and threshold to motorcycling. It must be possible for both women and men to get equal training and testing which is not the case today. Women fail the test more often after the third DLD. One reason is that a new test is demanded between A2 and A and that stricter demands on the test vehicles have been introduced which made a lot of low motorcycles with an effect of 40-50 kW impossible to use at the riding test. People with some sort of disability should must also be included in the DLD. With a possiblity for exemptions during the training and testing this must be made possible in the next directive. The number of motorcyclists are increasing in Sweden while at the same time the number of fatal and severe accidents are going down. However, one third of the fatal and severly injured over the last ten years didn’t have a valid license at the accident. The number and share is increasing since the third DLD was introduced 2013. SMC agrees with the commission that the safety of riders must be highlighted. But, to make it more difficult and expensive to ride a motorcycle is not the solution. Instead it is obvious that the content of the education and training is most important to reach Vision Zero. For SMC it is important to share our view in the published roadmap on the revision of the current Directive on driving licences. Our full response, see attached file.

Response to Sustainable and Smart Mobility Strategy

SMC is Sweden’s only motorcycle association for riders on the road. We represent both members and 500 000 motorcycles and moped owners in our country. We are in favour of an initiative to produce a EU strategy for sustainable and smart mobility. However we would like to change the namne to Sustainable, smart and SAFE mobility. SMC has worked with environmental issues for many years, at different levels and in different fields. We've published a unique sustainability report (attached) based on Global Reporting Initiatives. https://www.svmc.se/smc_filer/SMC%20centralt/Rapporter/2019/Sustainability_Report_V2.pdf PTWs must be included in the work to create a EU strategy for a sustainable, safe and smart mobility. The number of fossil free PTWs is increasing. About one third of the sold mopeds in Sweden this year are electric. Motorcycles and mopeds are smart vehicles that can contribute to increased accessibility and reduced congestion with the right stimulation. The Covid-19 pandemic has also shown many advantages of PTWs in different ways. Citizens in Stockholm were asked to stop using public transport this spring and at the same time the parking fees for PTWs were removed to encourage the use of PTWs until the pandemic is over. Persons in health care have been offered PTWs to use in their work for a safe mobility. A growing fleet of PTWs are transporting goods, food, medicin etcetera to citizens in the risk groups who are staying at home according to the recommendations from the government. Carbon dioxide emissions from road traffic in Sweden in 2018 were 15,45 million tons of carbon dioxide. Of this, motorcycles and mopeds contributed 0.5 percentage (0.080 million tons). The number of PTWs is increasing while the emissions are going down. This is a result of cleaner bikes. Studies show that if more people choose to ride a motorcycle instead of a car, queues and exhaust emissions would decrease and the parking spaces would suffice. If motorcycles were allowed to use the bus lanes, accessibility and safety is improved, riding time is reduced, and carbon dioxide emissions are reduced further. In order to stimulate the purchase of electric motorcycles, a ”super-motorcycle bonus” corresponding to the car should be introduced. Sweden is a huge country with 10,2 percent of the land mass in Europé and a small population(22,2 sqkm). Despite geography and climate, PTWs play a significant role, in urban and rural areas. Public transport, walking or cycles are not always an option, then the car is the most popular choice resulting in traffic jams. Outside the bigger cities public transport is limited or non-existing. Individual transport will always play a role in urban and rural areas. The number of gas stations has dropped. It can be difficult to travel in parts of Sweden with a motorcycle due to their small tanks. A plan for sustainable and smart mobility must include ways to charge all vehicles /fill out tanks every 100 km. The charging stations must be open to PTWs which is not the case today in Sweden- motorcycles aren’t allowed everywhere. Motorcycles must be included in the plans of charging infrastructure. Smaller vehicles have smaller battieries and must charge more often. We need a global standard for the charging of electric vehicles. There is also an urgent need for a common payment method for charging electric vehicles. All stakeholders should encourage the use of electric motorcycles and other powered two-wheelers as well as the development of better, more lasting and more environmental-friendly electric engines. This spring SMC has published 16 articles about buying, riding and owning an electric motorycle to increase awareness among riders about the new technique. Our historic vehicles must also be allowed to remain. Sweden has a world-unique engine culture and technical expertise. The ability to repair, recycle or recreate old items are skills that must be preserved and passed on to future generations.

Response to Rules on vehicle transmission and test vehicles for A2 motorcycles driving licences

I write on behalf of the Swedish Motorcyclists Association, SMC. SMC agrees with the proposal to change the demands for test vehicles A2 from a minimum of 395 cc to 250 cc. However this is not enough. We look forward to future changes of the test vehicles for all A tests in order to make the tests gender neutral. There is a difference in approval rate between women and men in Sweden and other MS. This will probably grow with the demands that was introduced in 2019 for the test with A motorcycles.
