Response to Consumer Agenda 2025-2030 and Action Plan on Consumers in the Single Market

Swappie welcomes the opportunity to contribute to the shaping of the EU Consumer Agenda 2030. As a European leader in smartphone refurbishment, we are committed to driving sustainable, affordable, and safe consumer choices. We encourage the Commission to consider the following priorities as it develops the future consumer policy framework: In light of the forthcoming Circular Economy Act and its strategic priorities, the EU Consumer Agenda should place stronger emphasis on policies that actively encourage sustainable consumption patterns and promote the reuse and repair of products. Building consumer trust in second-hand and refurbished electronics depends on greater transparency (for consumers) and fairness (between traders) including clear pricing guidelines for spare parts and a universal right to repair that allows consumers to choose independent service providers, free from restrictions imposed by the original manufacturer. We support the development of a quality repair standard as announced in the RIght to Repair Directive. By extension, if refurbishers could qualify for the label it would bring easy, comparable information to consumers and increase trust in the refurbished product category. While limited details are available on the forthcoming Digital Fairness Act, we welcome its direction and hope it will provide a robust framework to address business practices that exploit vulnerable consumers and promote unsustainable fast-consumption models. The EU already implemented durability requirements for some consumer electronics, those measures need to be supplemented in order the prioritisation of product quality over quantity. Finally, we would like to reiterate that enforcement of the rules should remain the priority, and that regulatory fragmentation and overlapping obligations only make it very difficult for mid-cap companies to operate and scale in Europe.

Response to Environmental impact of mobile phones and tablets - Ecodesign

Swappie is a European scale-up company, established in Finland in 2016, on a mission to make refurbished mainstream. We are a smartphone refurbishing business and the leading end-to-end online destination for buying and selling refurbished iPhones. For refurbishers, the legislation needs to ensure that we have the ability to test, service and repair devices safely, outside of the control of the original manufacturer. Today third party repairs are becoming increasingly difficult as smartphones are getting more and more complex and integrated with software. OEMs are increasingly using software locks to make repairs impossible outside of their authorised network by serialising parts leading to a significant majority of devices that could be economically refurbishable to become waste. It is critical to get those requirements right as they have the potential to completely change how those very popular devices are designed and manufactured and potentially propel the refurbishing and repair sectors in Europe. We truly believe this initiative can have ripple effects far beyond European borders by opening up access to the after-sales market to independent providers, accelerating the green transition (through eWaste prevention and curbing CO2 emissions), providing more choice to consumers, supporting the creation of European jobs and making Europe the global leader on ecodesign and right to repair. A longer submission has been attached which focuses on 1)Part serialisation - We are worried that paragraph 2 (e)(xi) seems to expressly allow the procedure of part serialisation through software pairing. In practice, without the software to “complete the repair”, the replacement part will not be properly recognised by the device, certain key functionalities will be turned off (eg. battery health features for batteries, or facial recognition or front camera portrait functionalities for cameras) and the user will be prompted with a safety popup message for a certain period of time, even if the replacement part is an original from the manufacturer. The use of software in repairs to serialise parts needs to be banned outright: consumers should never have to have the quality of the repair lowered or their user-experience degraded because a repair is completed outside of the authorised network of the manufacturer. 2) Registration procedure - We are also concerned that the criteria to be registered by the OEMs are left at their entire discretion. If criteria for the registration are not clearly mandated and entirely up to the OEM’s scrutiny this is no different than the approved authorised networks already in existence. We fail to see how the proposal would change the status quo and make an actual difference to ensure independent service providers have better chances of being “approved” and “registered” with an OEM. Especially if access to parts is dependent on being registered with the OEM. 3) Access to parts and manuals - We generally support longer availability periods in order to ensure refurbishers have the ability to service devices for a longer period of time. Refurbishment and repairs should also be possible in Europe using compatible parts, not just original parts. We urge the legislation to allow schematics for parts to fall into the public domain after a certain period of time. 4) Software updates - As a rule, software should not be used as a way to limit the useful lifetime of the device. We suggest that software security and conformity updates should be available for a min of 7 years after the first placing on the market and that they should never interfere or degrade the performance of the device for example by slowing it down. At any point in time, if it is clear that the software is interfering with the functioning of the device, there should be a possibility for end-users to roll-back to a previous version of the software or operating system.
